Seeking Felony Indictment for Puppy’s Torturous Death

Target: Paul Howard, DA, Fulton County District Attorney

Joshua Molder, age 17, and brother Justin have been accused of Aggravated Cruelty to an animal and two other charges, and are currently jailed without bond. This petition, however, is focused on the Aggravated Cruelty charge.

ATLANTA -- Two Atlanta brothers are in custody at the Fulton County jail charged with the torture death of a five-month old puppy and trashing a local apartment complex. Seventeen-year old Joshua Molder and 18-year old Justin Molder are being held without bond. The Molder brothers stand accused of covering a puppy with paint, hog tying it, trying to set it on fire and when that didn't work, baking the puppy to death in an oven. Inez Marshal is president of the community association at the Englewood Manor Apartments in southeast Atlanta where Joshua and Justin Molder lived. She was called to the rec center the night the brothers were arrested for breaking into the newly remodeled building and trashing it. "They just totally demolished the community center," said Marshal. She said she'll never forget finding the puppy the boys stand accused of torturing and killing. "He was still in the oven; he was tied," said Marshal. "All four feet were tied together, his mouth was duct taped and he was dipped in beige paint," she added. "Not only did they not have an explanation, apparently they went out and bragged about this to other young people in the community, brought them back and showed them their work," said District Attorney Paul Howard. The Moulder brothers are charged with burglary, criminal damage to property and aggravated cruelty to animals.

We ask that the DA of Fulton County, Paul Howard or the attorney assigned to this case, aggressively seek indictment of a felony for this heinous criminal act based on the Anti-Cruelty Statutes of Georgia:

16-12-4. Cruelty to animals c) A person commits the offense of aggravated cruelty to animals when he or she knowingly and maliciously causes death or physical harm to an animal by rendering a part of such animal's body useless or by seriously disfiguring such animal. A person convicted of the offense of aggravated cruelty to animals shall be punished by imprisonment for not less than one nor more than five years, a fine not to exceed $15,000.00, or both, provided that any person who is convicted of a second or subsequent violation of this subsection shall be punished by imprisonment for not less than one nor more than five years, a fine not to exceed the amount provided by Code Section 17-10-8, or both.

Wow! What a pair of cretins! Lock 'em up and throw away the key.

One thing that a lot of people don't understand--and don't WANT to understand--is that sickos like this frequently get sexual gratification from this sort of thing, until the novelty wears off--at which point they start looking for victims further up the food chain.

This is ridiculous, y’all want to lock them up for a “crime” in which NO ONE had their rights violated. Yes what they did was sick and disgusting and there is no way in hell I’d ever want to be in the same room as them but they did not hurt anyone. At best they should be fined for destruction of property and only if it wasn’t their dog...or oven.

Look, the only just propose of the law is to defend the rights of the PEOPLE or to facilitate that end. I’m sorry but animal cruelty laws do not fit the bill. Unless you want to start artificially extending rights to animals, anything that happens to them is not a violation of anyone’s rights and hence should not be illegal.

Like the man says you can’t have your cake and eat it too. Our law is not based on “majority rules” but on individual rights. Just because you don’t like what someone else is doing doesn’t give you the right to force him to do as you or the majority wills.

I am far from a PETA person. And, I believe human rights should always have considerably more attention and justice than those of animals.

However, these guys should have the book thrown at them under the appropriate criminal statute.

These two are well on the way to becoming serial killers. Read John Douglas' books for details (be warned--they are not for the squeamish, he's a retired FBI profiler who explains everything, including the stuff you never want to hear about).

Huh? These sub-humans didn't just "kill a small animal". They tortured a puppy to death, viciously, and then were so proud of themselves that they ran around bragging about it to their "friends" and inviting some of them over to look at their achievement. They will NEVER be in any condition to roam around free in human society. People who think torturing sentient creatures is fun are simply lacking the type of brain function that forms the basis of human society. Their mental defect is identical to that of people who enjoy torturing humans, and it's incurable.

You make me as sick as these sadists. Check the law. It's constitutional and it's not an unreasonable siezure of property under those circumstances. The constitution does not forbid any seizure of property, just unreasonable seizure. To prevent cruelty to animals, it is not unreasonable siezure and that's why we have animal welfare laws that have been tested in court and found to be constitutional. And that is all I have to say to you.

One of the things I heard in a lecture last year was that when the NYS Humane Law Enforcement agents go to a house and investigate an allegation of animal cruelty, It's a safe bet that there are other forms of abuse going on- Either a battered wife or child abuse.

May be so, but not all those who kill small animals turn out to be serial killers. I think a light jail sentence combined with hundreds of hours of service(in dog shelter, etc) should do it.

In that case, I hope they move next door to you and you let them babysit your kids.
