JIMMY CARTER has criticized, but has been powerless to stop, the Bush administration's warrantless wiretapping of al-Qaida suspects' communications. Until last week, that is.
On Thursday U.S. District Judge Anna Diggs Taylor, a former civil rights activist appointed to the federal bench by Carter in 1979, ruled the wiretapping program unconstitutional.
The plaintiffs were journalists, attorneys and activists who want to contact al-Qaida members and suspects overseas. They alleged that the NSAs practice of monitoring international communications of al-Qaida members and those suspected of being in or aiding the group violated their First and Fourth Amendment rights. How? Terrorists and suspected terrorists who think they are being monitored have become reluctant to engage in international communications, making the plaintiffs' jobs more difficult.
The plaintiffs failed to prove this alleged harm. Contrary to standard legal practice, the judge said they didn't have to. The allegation was enough for her. They also failed to prove that the NSA program, as opposed to al-Qaida surveillance conducted by Britain, Pakistan and other countries, was the source of the harm allegedly done them. Plus, if the harm was not the program itself, but the fact that the terrorists knew of the program, shouldn't they have sued The New York Times, which reported the program's details?
Judge Taylor went on to rule that the wiretapping program violated the plaintiffs' First Amendment rights to free speech and association, and Fourth Amendment rights to be free from unreasonable searches and seizures. How? By making it harder for them to do their jobs that involve interviewing al-Qaida suspects.
So to make the jobs of journalists, attorneys and political activists easier, Judge Taylor ruled that the job of the National Security Agency -- to thwart future terrorist attacks by monitoring the communications of known and suspected terrorists -- must be made impossible.
Jimmy Carter couldn't have made a more foolish ruling had he written it himself.

This is another reason to NOT vote for Dems. Their wacked out liberal thinking just endangers the U.S.

If we could only keep the New York Times and other Anti-Bush, Anti-American news organizations out of the government's business, it could be done.
We should take all past Presidents and put them away where they can do no more harm after their time in office. (I know Carter did this in office)

I said before, our enemies are not just Al Quaeda and similar terrorist organizations. We have our own homegrown enemies right here. And this judge and the ACLU are among them.
The way all the MSM should describe the governments surveillance program.
The main MSM also does not highlight the fact that the plaintiffs in this case are Muslims.

I don't know how long the appeal of this ruling will take, but, it will be interesting to watch the Bolshecrats squirm between using this to impeach Bush and we must continue to wiretap for national security.
There are two thing I am certain about if the Bolshees get back in power:
1. They will use the same tactics they have been railing about against Bush and the Republicans. After all, they are the real enemy. Enemies that want to kill you don't count. Those that want you to think it is your money are evil.
2. Elections will be meaningless. Pretty much on the Sadam Hussein model.

I was too young to vote when he became president. When I saw the election results come in, I knew America was in trouble. What a sad day that was.... I will never forget that day. I was in shock that such a loser could be an American president.
I think he had a romantic attachment to the great depression days, and hoped to bring it back.
After he was elected and implimenting policy...
I remember the unemployment lines, blocks long.
I remember the lay-offs.
I remember people buying houses, at almost 20 percent interest rates, and houseing sales almost stop.
Yet this buffoon refused to lower tax rates, because he thought America had seen its better days and should get used to a lower standard of living. He couldnt stand the fact that people might make some money and keep some of it, and choked off all new business opportunities.
It seemed like he was telling us we had to accept misery. The man was promoting that we wallow in self pitty. It was sick and disgusting.
I remember when Reagan ran against him. First President I voted for. You could see it in peoples eyes when you went to the polls. People were so pissed off and couldn't wait to fire Jimmy Carter. Democrats and Republicans alike.
Lets hope the Main stream Media takes an honest look back at this mans record when he expires. Thats what he is afraid of, and why he never not get off the stage.

Just a question...Is Judge Anna Diggs Taylor any relation to former crooked Detroit Congressman Charles C. Diggs Jr.?
I remember Congressman Diggs was brought down in a scandal involving the "House of Diggs" Funeral Home either in the late '70's or early '80's.

Former Rep. Charles Diggs Jr., who served 26 years in Congress before he was censured by the House in 1980 and resigned after being convicted of operating a kickback scheme, died Monday night. He was 75.
Diggs, a Democrat who represented Detroit, died of a stroke at a Washington, D.C., hospital, said his son, Douglass Diggs of Detroit.
He was elected to Congress in 1954 and became a leading black spokesman in the House. He was convicted in 1978 of operating a payroll kickback scheme in his congressional office but was subsequently re-elected. He resigned in 1980.
Diggs served seven months of a three-year prison term.
He claimed he was a victim of selective prosecution and double standards. It was a position he maintained throughout a trial that produced guilty verdicts on all 29 counts, a lengthy congressional inquiry and ensuing years of financial and legal trouble.

They filed an appeal and had the order 'stayed' until it can be reviewed by the SCOTUS.
So it's a 'no win' for the Judge and Carter.

The Honorable Charles C. Diggs, Jr. was found guilty in 1978 for taking kickbacks from three of his congressional staffers; he was re-elected to office; then censured by the House, and finally resigned, then went to prison for 7 months.
Indicted of 11 counts of mail fraud and 18 counts of falsifying congressional payrolls. Prosecutors said he received $66,000 in kickbacks from 1973-1977 from several staffers, and used some of that money for his personal business and congressional expenses.
Guilty of: Diggs was found guilty of all 29 counts against him in October 1978, then the next month he was re-elected to his 13th term in Congress.
