AN appeal court has quashed the convictions of the first man jailed under Australia's new anti-terror laws.
Joseph Terrence Thomas, dubbed Jihad Jack, was arrested in Pakistan in January 2003 and convicted in Australia in February this year of receiving funds from al-Qaeda and holding a false passport.
He was sentenced to five years' jail with a minimum term of two years.
But today, Victorian Court of Appeal Justices Chris Maxwell, Frank Vincent and Peter Buchanan quashed the convictions, saying the evidence used to find Thomas guilty was inadmissable.

The Bad Guys will succeed because they can use our silly rules against us. They do not recognize rules, and are therefore not constrained by them. We are, and thereby we handcuff ourselves against them.
For as long as "we" (the Civilized world) allow this situation to prevail, we will continue to see the gradual and inevitable erosion of Society.
When that is thru, those who are left will enjoy life in Muslim servitude.
Bloody courts will have much to answer for after our first terrorist attack!
The courts must come up with another way of punishing cops/governments for civil rights violations than throwing out the evidence.
Letting the criminal go free, deters the civil rights violations but punishes all of society in the process.
One option is that courts should make officers/decision makers due community service in their free time for rights violations, but keep the criminals locked up.

I am in favor (not kidding) of a return of the Pillory. It's a very public sentence, carried out in front of everybody, that takes a day or so and costs next-to-nothing to administer.
For those more awkward situations, I am in favor of the cat-o-nine-tails, publicly administered.
Both punishments severe, unpleasant, appropriate, and quickly over-and-done-with. Better still, they are inexpensive on the public purse.
