Judge Upholds Subpoena of Reporters in Barry Bonds Leak Probe (Reporters not above the law alert)

SAN FRANCISCO — A federal judge told two San Francisco Chronicle reporters they must comply with a subpoena and tell a grand jury who leaked them secret testimony of Barry Bonds and other elite athletes ensnared in the government's steroid probe.

The decision by U.S. District Judge Jeffrey White means reporters Lance Williams and Mark Fainaru-Wada must appear before a grand jury investigating the leak unless a higher court blocks the ruling. The pair have said they would not testify and would go to jail rather than reveal their source or sources.

Even a San Francisco Judge spoke so now there is no excuse for the Government not to subpoena reporters to the Grand Jury in leak cases concerning national security

I think these subpoenas are going to be coming just before the elections and I'm pretty sure the government already knows who the leaker's are.

I believe subpoenas have already been issued according to macranger. I agree the government already knows who the leakers are. I think we will hear of "suspects" or indictments or indictments coming before the elections. I am not sure how close before the elections but it will destroy the donks hopes of winning the senate and/or the house. Rep. Jefferson will be charged also and may implicate others through his seized files from his office.

"In his ruling, White said his hands were tied by a 1972 Supreme Court precedent that no one, including journalists, was above the law and may refuse to testify before a federal grand jury that has subpoenaed them. He added that Congress has not adopted a shield law to protect journalists from testifying before grand juries."

I love this line by obviously a liberal judge who didn't want to issue this ruling but was bound by law.

I thought a Judge has already ruled the government is not allowed to look at the documents seized from Jefferson's office?

Likewise, even if Durbin AND Rockefeller are indicted as the leakers to the NY Times, to their voter base, they will just say "It's Bush's fault, and in good conscience and for the sake of the children, it was my DUTY to get the public the information that the White House REFUSED to let the people know...." adn the DU crowds will cheer and vote for Democrats anyway.

I know that is great! I believe he is talking about the "pentagon papers" case. Reporters always forget to completely and accurately inform the public of the complete ruling by the supremes. They always say the pentagon lost that case, which is not true in theory.

Actually thej udge ruled in favor of the DOJ, yet has allowed an appeal on his decision, so for the time being, the DOJ can not go through the papers. This will be resolved before Nov.

Regarding Rocky, Durbin, et al, you are right most of their supporters will stand by them but the donks will lose the independants and conservative and moderate dems. Middle Ameerica will turn away from the party of jackasses and vote GOP in the elections.

I know most the MSM will try to bury this but I think this could be one of the most important upholding of a previous ruling there maybe with regards to the CIA, NSA and other fed leak investigations.

Reporters should be held accountable. They should not be given a pass like they are God's chosen profession.

Leaks in government should be looked into and dealt with, but the problem with resolving issues are everyone's political connections which runs blocking against law enforcement.

"Middle Ameerica will turn away from the party of jackasses and vote GOP in the elections."

I hope that is the way it turns out, and that Flyover Country once again rises up in numbers at the polls.

An internal GOP poll was released late last week and the republican leadership was more than surpised and happy with the results. It was like 96% od republicans were planning on voting in Nov. and Bush was supported by almost 90%!

The party faithful will come out in droves in Nov. and, the gop is always better at voter turnout.

Our choice is limited to two bona fide RINO's, but that's still way better than the socialists running against them.

The main thing here in Ohio is to get Ken Blackwell elected to the Governorship, with all the damage that Bob Taft has done to this state in the last 7 years.

When we have people in pockets of the state that elect someone like Dennis the Menace Kucinich, who is a socialist pure and simple.

Yeah I know. Republicans, most independants and even dems realize that a Pelosi house and a Reid senate would be an absolute disaster. Thanks goodness the donks are in such poor shape and have such terrible leadership.

I meant to say "some dems" becaue the majority of the party of jackasses still support Pelosi and Reid.

I am watching airhead Kucinich present the "Kucinich four point plan" for the war on terror (on O'Reilly):

1) Cut and run in Iraq (what a shocker)

2) Fund first responders at home (union members, or course, and we're gonna need plenty of first responders if we run away from the Terrorists)

3) Make friends with our allies (including France, HA !)

4) (The piece de resistance: negotiate with the Terrorists !

Just lookin' at Kucinich (who was there to say "you keep saying no Democrat has a plan for the war on terror, and I've got the Kucinich Plan), is enough to cause one to lose their lunch...what a maroon.
