Shooter is holding magazine you can see the bottom sticking out from his hand.
You don't hold the magainze on an M4 carbeine. Not designed that way. What he's holding is too far forward on the rifle to be a mag anyway. It's probably a custom foregrip. I can see the bystander's blue shirt through where the magainze should be obscuring it.
The rifle is not loaded.

Ok, I did a bit of poking around and it seems that there are a few things that stand out about this picture.
The weapon first of all. A like new M4, it DOES have a magazine however its hidden behind the sling but who over there has access to a brand new M4 with an Eotec site and front handgrip? Kind of an unusual weapon to see a Jihadi with.
What did it for me and make me think it was a fake was his hand on the pistol grip. Look at the white outline.. almost as if it was cut and pasted without touching up that area.
Also the shadows look off, the depth of the picture looks off as well. I could be wrong but my vote is the shooter was added to the image after the fact.

What is (or do you suppose) the black, turd-like item is; slanted, leaning north by northwest, directly in front of the shooter's forehead, partially obscured by the rifle's 'carrying handle'? (And pls forgive me if I mis-state the name of the rifle part)
This element is lit "all around" and to me is the most incongruous/evidence of clumsy, 1940's "cut-and-paste" item in the pix.

That area would be clear if it were an M4, which has a narrower stock.

That's my take as well. That said, it is always possible that it is not staged, but it is not relevant.I've seen many Arab generated photos of street urchin type kids hanging around Jihadi shooters. It's almost unavoidable since with high birthrates they have many kids in the streets of Gaza etc
The Jihad fighters also view the kids as learning the trade. Fetching tea and ammo for them
Thus the photo being minimally staged is the way I see it. The boys were there for the action anyway and the Arab photographer only had to get them to pose a tiny bit

It does look funny, the way the shooting guy stands out, but sometimes digital cameras create some weird looking effects.
I also look to motive, and can't see any reason why somebody would photoshop this picture. It's easier to just shoot the picture for real. In the middle east, there's no shortage of knuckleheads with guns or idiots to stand around watching them shoot them.

If what I see is correct it looks like there IS a mag.. its just a 20 rounder not a 30 and does not extend down past the sling so you cant see the rest. If you look close you can just make out the grey of the mag.. however I do still think the photo is a fake.

This one is obvious. There's no mag seated in the magazine well. Unless Captain Jihadi here was opening the action and inserting one bullet at a time into the chamber, then this gun isn't shooting. The photo is a clear, and poor fake.

That is the design on the t-shirt. No mag.
I vote for staged. One round in the chamber for the fauxtographer.
Shooter is closer than the others (maybe 6-8 feet?). That may account for a number of things; light angles, sharpness, etc.
