LOS ANGELES -- A judge who threatened deportation to Mexico for an illegal immigrant seeking a restraining order against her husband has been dropped from the roster of part-time judges used by the Los Angeles County Superior Court.
Judge Pro Tem Bruce R. Fink, a family law attorney from Orange, was removed from the list of about 1,200 attorneys who are used as substitute judges for the county, court spokesman Allan Parachini said Friday.
"A lot of people run from controversy," Fink said. "It doesn't bother me. Remember, I was doing this as a volunteer."

It was thrust upon him the minute he asked if she was illegal and got an affirmative answer. I'd have kicked him off for the counting to 20. She didn't need a count of 1. He should have deported her then and there.
Unfortunately the judge needed to be disciplined - Federal policy is to grant waivers to witnesses of felonies and she was reporting a felony so the judge should have at least checked out the circumstances - if he wants to enforce Federal law from a county bench he at least needs to know how its done.
She was asking for a restraining order based on verbal abuse, not appearing as a witness in a criminal case. I don't think that qualifies for a waiver.
The net is why is this case even in court. She was an illegal immigrant! Case dismissed...... Next.... I am not against immigration but just illegal immigration and I am tired of my tax money being wasted to protect those that can't, in most cases, speak the ENGLISH language, don't belong here, etc. As for the judge being dropped it is just another appeasement action for the illegal populace and those who pontificate that they do belong. Nah, she isn't a citizen of the U.S.A., period.

Welcome to California. A few rules before you get started:
#1) Don't speak the truth that breaking the law to enter the country without authorization is wrong. We celebrate those take the initiative to find "alternate entry to the US."
#2) Don't EVER criticize anyone who is an illegal alien. They are a protected, sacred caste.
#3) Free speech is only allowed when spoken against the US or Republicans, never against any of the Democratic party's sacred constituencies such as illegal aliens.

That's what I got from the original article:

There is likely more to this story. From the previous thread, this illegal was married to a U.S. citizen. If he was abusing her, she needed the restraining order for two reasons. First, to protect herself from violence. Even if she wanted to self deport, she could still be confronted by her spouse. Secondly, a victim of domestic abuse, irrespective of immigration status, can use that abuse as grounds to adjust status to a lawful permanent resident (i.e. get a green card) under the Violence Against Women Act. Getting the restraining order would act in her favor with immigration authorities. And that's why state judges can't get into immigration issues. Some of the legal provisions in immgration law are counter-intutitive with respect to criminal law. By granting her a restraining order, the judge would be helping her immigration situation, not making them worse.

You may be right - I thought it was physical abuse.
As soon as Aurora said she was here illegally, she should have been arrested. It should not be a Federal case or a Pro-Tem case it is purely a case of felony, a crime punishable by law. The police should have stepped in - are their hands tied also? Then a 'citizen arrest' should have been made. Someone have the guts to do the right thing and Deport Her!
Being in the U.S. illegally is not a crime, especially not a feloney. Currently, all the police can do is notify immigration authorities. Only immigration can detain someone for immigration violations. The new House bill would change that if passed unaltered.
If Canada, Mexico and the U.S> merge, it will be officially bilingual. You get to speak Spanish or French. And the Quebecers will make sure Mexico offers services in French or they'll threaten to separate :)
