Maybe I had a different source for the original story, but I was under the impression that the judge was warning her that if she pushed it she could be deported. It would be like a cop pulling you over to tell you "I clocked you going 90 and the cops in the next town give tickets for that. Slow down and have a nice day."

That's what I got from the original article:
"Fink, an experienced lawyer specializing in family law, defended his action, saying he believed that the couple had just had a spat and did not really want to separate. He said that granting Gonzalez a restraining order would have also ended her husband's efforts to get her legal status -- "We'd wind up with exactly the opposite of what these people wanted.""
