Court Rules Against Sanitizing Films

SALT LAKE CITY (AP) -- Sanitizing movies on DVD or VHS tape violates federal copyright laws, and several companies that scrub films must turn over their inventory to Hollywood studios, an appeals judge ruled.

Editing movies to delete objectionable language, sex and violence is an "illegitimate business" that hurts Hollywood studios and directors who own the movie rights, said U.S. District Judge Richard P. Matsch in a decision released Thursday in Denver.

"Their (studios and directors) objective ... is to stop the infringement because of its irreparable injury to the creative artistic expression in the copyrighted movies," the judge wrote. "There is a public interest in providing such protection."

Matsch ordered the companies named in the suit, including CleanFlicks, Play It Clean Video and CleanFilms, to stop "producing, manufacturing, creating" and renting edited movies. The businesses also must turn over their inventory to the movie studios within five days of the ruling.

"We're disappointed," CleanFlicks chief executive Ray Lines said. "This is a typical case of David vs. Goliath, but in this case, Hollywood rewrote the ending. We're going to continue to fight."

CleanFlicks produces and distributes sanitized copies of Hollywood films on DVD by burning edited versions of movies onto blank discs. The scrubbed films are sold over the Internet and to video stores.

As many as 90 video stores nationwide -- about half of them in Utah -- purchase movies from CleanFlicks, Lines said. It's unclear how the ruling may effect those stores.

The controversy began in 1998 when the owners of Sunrise Family Video began deleting scenes from "Titanic" that showed a naked Kate Winselt.

The scrubbing caused an uproar in Hollywood, resulting in several lawsuits and countersuits.

Directors can feel vindicated by the ruling, said Michael Apted, president of the Director's Guild of America.

"Audiences can now be assured that the films they buy or rent are the vision of the filmmakers who made them and not the arbitrary choices of a third-party editor," he said.

First of all, you call me a "self motivated expert" because I give you an answer concerning your snide comment "wait until you have children to answer." I answered you question sir, and I could care less if you lack the brain power to answer the question back with any intelligence.

You compare me to Madonna of all people because I claim America has freedom of expression? How dare you. Just because Hollywood won't open the floodgates and let companies edit and sell their movies does not mean it is not right because "you're children could be corrupted." It's a sad thing going on in America when parents some parents would rather just ban everything they find offensive so their children aren't exposed to it. Pull the plank out of your own eye buddy before you start spouting off you words words of utter intellectual garbage. America should just become a state ruled by Islamic law. No more garbage in or out of this country. How about we live like they do in Kuwait? Absolutely no open air concerts. Why? Because you don't want your children to be affected. The same ideas you are spouting right now, and the path you seem to want to take is the same thing the ACLU does. Ban saying Merry Christmas because a very small percentage of the population is offended by it. You disgust me.

I never said buying a movie and cleaning it up is breaking the law. Do you have Q Tips available, or do you need your prescription eye wear filled? This post is about companies cleaning up discs and selling them. I am sorry if you are trying to prove your point by totally switching the idea being debated here, but if that makes you feel like you know something, so be it. But just know it makes you look like a total fool.

Your comparison also needs some work. How about this comparison. "If I buy a cake and eat only the frosting and throw way the bottom part, does that mean I am destroying the bakers artistic ability by not eating the whole thing?" Sound ridiculous huh? Well guess what, that is the same thing I thought when I read your comparison. I do not believe there are laws against putting certain hubcaps on a car when it is your own property. You can't manufacture 100 55 Chevy's and sell them. Apples to apples please. Once again, ridiculous comment by someone who is so infuriate with the left he can not even speak rationally.

The pornographic example makes me think you are even more of a hypocrite. Many people scream on this site about how the libs want to outlaw guns because the say guns kill people. But conservatives say the person pulled the trigger. Now, you give an example about an ignorant pro basketball player and you blame it on the pornographic movie? You're lack of grasp on the subject at hand has caused you to pull subject out of the air that do not pertain to this one, and it shows you are weak on your position. The driver caused that crash, not the pornographic movie. Stop reading your liberal play book and come back to earth.

I am shocked and appalled at your baseless attacks when your own argument was built on sand in the first place. I beg you, and take it however you choose, don't say one thing and not expect a response, then bash the person for actually responding to your snide and ignorant comments.

If the media in question were physically alterable, such as videocasette or motion picture film, I would think the First Sale doctrine would protect CleanFilms if they physically altered copies of the films they rented, since once they purchase such copies they are theirs to do with as they see fit.

The proper solution would be for a company to sell DVD players that could accept open-format "edit lists". I think there was legislation awhile ago to explicitly allow for such, though I don't know what happened to it.

Or do you only want them when they protect things that you like politically or religiously?

Sure seems like that to me.

Cut all the liberal hollywood crap its not germane to the argument. Immigration and NAMBLA and ACLU are not parts of the argument either, just your emotional ramblings.

Its about the right of the copyright holders to not have people destroy and profit from their work.

Read this paragraph in the story. It should clear it up:

No, they did do something wrong in this, they altered something that they didn't have permission to do, whether its something you agree with or not, it was wrong. Liberal or conservative, it was wrong.

Let's sue people for the very freedoms written in the constitution. Theaters are supposed to keep children under 17 out of R rated movies. You can't buy them in the store unless you are a certain age. You want to see disgusting, go to Europe and watch some comercials on public TV. Listen to the things they say.

Your tactics are just like the ACLU. Sue them because they aren't your beliefs and the freedoms they express "offend you." Ugh. Conservatives like you make me ashamed to call myself one.

You want controlled media, move to North Korea.

They purchased the DVD, they have to abide by the license, that is what the law says. They didn't have the license to change the DVD.

Also, Congress may tailor copyright law at will. There is nothing binding Congress to keeping copyright law tomorrow what it was today or yesterday.
