Supreme Court Says Muzzleloaders are Legally Firearms

The ruling comes in an appeal by a convicted felon who says he thought he was allowed to own a black powder rifle. Such rifles are excluded from the federal definition of firearms.

A spokesman for the Wyoming Game and Fish Department says the ruling will come as a blow to some Wyoming residents who have felony convictions in the past but who are now dedicated black powder hunters.

Governor Freudenthal says he would favor changing the state law to allow convicted felons to continue to hunt with black powder guns.

The court ruling released Wednesday upholds the conviction of Frank Alan Harris in a Casper court on a charge of being a felon in possession of a firearm.

According to the court ruling, Harris was previously convicted of aggravated robbery and robbery.

Yeah, I bought and 1893 7MM Spanish Mauser as an antique and enjoyed a paperwork free transaction. I'm sure the commies would get their panties in a serious bunch if they knew what a great shooting rifle this is. It will rival any modern bolt action sporter on the market for acuracy. :)

Reread #91. The technical term "firearm" EXPLICITLY does not include an "antique firearm". This is true for both tax law purposes and criminal law purposes.

Why you cannot or will not understand this fact eludes me.

If you don't believe me, ask your lawyer. Or ask the BATF. Whether you care to admit it or not, muzzleloaders are NOT firearms, are not subject to the taxation and licencing restrictions of firearms, and are routinely sold in legal interstate commerce by outfits not having an FFL to private citizens not having an FFL.

These are facts. Deal with them.

That is a felony, along with a myriad of other things.

Not to mention we now have the Lautenberg Amendment which forbids people convicted of certain misdemeanors from possessing firearms. Next will be DUI convictions. Then reckless driving. Next thing you know, not making timely payments on your student financial aid will be enough to take away your 2nd Amendment rights for life.

There's serious talk of banning "sex offenders" from owning firearms which sounds all fine and dandy except that in some places, drunkenly urinating behind a dumpster in a dark alley is considered a "sex offense."

I think many states simply prohibit felons from possessing deadly weapons. Period. That would do it. Next case.
