Driver wrestles gun from carjacker, suspect killed
Guernsey County Sheriff Mike McCauley says 44-year-old John Toubell of Antrim sneaked into the back seat of the parked car while the driver was inside a gas station early yesterday.
Twenty-nine-year-old Brian Starr of Cambridge says he saw a head in his rearview mirror as he drove away, and then he saw a gun.
Starr was shot in the leg as the men scuffled for the gun. Starr got the gun away from Toubell and shot and killed the suspect.
The sheriff says the shooting appears to be self-defense because the motorist had been shot first. An autopsy is planned today.

I would say it is self-defense because the attacker had a gun.
I guess it isn't really armed robbery at a convenience story if the gun doesn't go off or isn't even a real gun.
Thats the same thing that stuck out when I read this otherwise happy story.
I'm surprised they did not charge the guy who's still alive with stealing the perp's gun. I'm sure they can find something that he did that's illegal.
I'm no lawyer, but I think it has to do with the media must refer to any perp as a "suspect" until the "suspect" is convicted.

Wow, good news on the justice front today. First the Supreme Court reinstates the Kansas death penalty. Then comes news the so-called Railroad Killer is to be executed in TX tomorrow. Now this.

It's their policy, but as I say, we don't convict dead men. Doesn't matter how many witnesses there are (and even video capturing the act), the media calls them "suspects".
In Canada, I've seen people refer to the alleged 9-11 hijackers. Same principle. No trial, no guilt.
He has family. It's always better to be safe than sued.
Cambridge is the county seat of my county---in fact, I'm heading into town as soon as I post this. BTW, I think the dead perp's name is Touvell (rhymes with shovel), and the whole damned family have been trouble around these parts for three generations.

Kaliforniastan has used administrative "definitions" to prevent citizens from legally moving handguns in a vehicle under any circumstances, and they are enforced in the liberal wacko counties in the state.
"Until Mr. Toubell's family sued for Wrongful Death stating that "John was such a wonderful human being, he would never hurt a fly, he was just misunderstood he was just trying to clean Mr. Starr's floor mats."

(This morning I discovered my car's rear window smashed at an attempted carjacking/robbery, so this story is all the more heartwarming to me)
