Susan Estrich: "Constitution Protects Reporters' Right to Publish Top Secret Info"

Susan Estrich just summed-up the Left's attitude toward today's NY Times' publishing top secret info on the Justice Department's bank record monitoring of terrorists' financing:

'The US Constitution absolutely protects a reporter's and a paper's right to publish top secret military information.' Further: 'One of the reasons Bush is low in the polls is that the president has lost the respect of the press.'

This is the party that plans to retake Congress. Utterly clueless and angry enough to destroy us for spite.

I gather from reading all the above that it is not a good idea to publish classified information! Particularly those that helps the enemies.

I would truly wish the Administration wold just gird up and arrest every SOB and charge th;em with high crime, etc. They need to set an example!

How much blood on their hands are we going to tolerate?

I think I'm going to get drunk tonight for the poor bastards who got hurt and killed due to the "leaks"!

they do not "tap" every phone they have the phone records which is like your bill
a list of the numbers you called and that called you, they then cross reference the numbers you have called and have called you if anything matches the list of suspected terroist numbers if anything matches then they get a warrant to tap the phone and listen.


by the way read your phone bill for your home phone or cell phone you should have no expectations of privacy
because anytime you are using a cordless phone or cell phone you are transmitting via radio waves and ANYBODY can recieve them....

Dr. Krautman is a wise dude but he was quoting the late Supreme Court Justice Robert H. Jackson (who also served as the chief Judge at Nurenburg War Crimes Trials).

What the media is openly saying here, is, yes it is classified and yes the government has appealed to us to not publish because in "their" view it would cause grave damage to the national security interests of the USA (the test for classification). But...we have studied the material and do not agree that it will cause grave harm to the USA, OR we feel that the benefits to the (sacred) peoples' right to know outweighs the alleged harm.

The media is not equipped to properly resolve those issues. They are arrogantly and blindly blundering into areas they cannot possibly fathom.

For one thing they look at the raw material and decide that it is essentially already or partly within the public domaine (or don't understand why it is classified). What they do not understand is how disclosure might compromise "sources and methods" of gathering intelligence. For example if it is revealed that OBL "said" in a meeting that Allah would like to see the St Louis Arch fall (for example), all OBL has to do is recall the precise meeting in which he may have uttered that casual remark, summon all who attended that meeting, give them all sodium pentathol or torture them to find out who the informant is and then kill him or her and his or her whole family. Or maybe the place where it was said was bugged, so they go back there, take out the bugs, kill to hotel staff, etc. It is well knowns that some idiot Senator (Leahy?) said we were tracking OBL on his cell phone. Media reported it even though told it was from a classified briefing. Guess what? OBL's cell went dead.

The Courts will give great deference to officials of NSA and other government officeie chared with classifying information. Calsted the media has bit off huge chunks of highly classified programs and gleefully disclosed them in an attempt to stop them [the Pentagon Papers case said media may have some right to disclose IF they are revealing government misconduct].

GWB and AG Al are way too late in responding to it. It is frustrating. I mean media disclosed the secret CIA flights and bort numbers, their air fields, their so-called secret prisons which were baselessly branded as torture sites. They have destroyed back-channels that every country needs in order to survive. Media has already and deliberately caused grave harm to the USA. No ally can trust us to keep tips or secrets private. No one will help us. Why is USA becoming isolated? Ask the media.

By this same logic...
I'm not quite sure where your coming from on this, but the free speech that is called out in the constitution refers to political disagreement with the current management. It does not cover revealing classified information.

The "logic" I was referring to is that the media automatically assumes that anything the government does in secret is government misbehavior. The mere existence of any program that is not faxed and Blackberried to the media is an insult to them and they assume something rotten is going on. So when they discover any secret program, their "logic" says it MUST be reported to the people. I can't believe their "logic" does not understand that loose lips sink ships.
