The special prosecutor wants to use our editorial as evidence. Sorry. "One of the mysteries of the recent yellowcake uranium flap is why the White House has been so defensive about an intelligence judgment that we don't yet know is false, and that the British still insist is true.
So imagine our surprise when Special Prosecutor Patrick Fitzgerald declared his intention last month to use that editorial as part of his perjury and obstruction case against former Vice Presidential aide Scooter Libby, who had also questioned Mr. Wilson's claims. It suggests that his case is a lot weaker than his media spin. Mr. Libby wasn't a source for our editorial, which quoted from the October 2002 National Intelligence Estimate concerning the Africa-uranium issue. But Mr. Fitzgerald alleges in a court filing that Mr. Libby played a role in our getting the information, which in turn shows that "notwithstanding other pressing government business, [Libby] was heavily focused on shaping media coverage of the controversy concerning Iraqi efforts to obtain uranium from Niger." The prosecutor comes close here to suggesting that senior government officials have no right to fight back against critics who make false allegations. To the extent our editorial is germane to this trial, in fact, it's because it puts Mr. Libby's actions into a broadly defensible context that Mr. Fitzgerald refuses to acknowledge.

Obvious to many, but apparently not to the judge, at least not yet. This case should be tossed out, and perhaps it will be at some point. Fitzy really messed up here buying into the lies of Joe Wilson; perhaps he will be enlightened, dismiss the charges againt Libby, and indict Wilson! HA!
Ironically, this case is about perjury, when Wilson is the biggest liar out there.

and I think this schmuck, Fitzgerald, is not finished playing politics. I think on the eve of the November elections he will come out with an indictment, or two, that will try and make the Bush Whitehouse look complicit.

The Special Prosecutors Ken Starr and Fitzgerald ,neither has enough good sense to pour pee out of a boot , with a hole in the toe and the directions on the heel.
I can't immagine he can keep the grand jury going for that much longer. I'm truly surprised it hasn't been shut down yet and the fact that he hasn't publicly cleared Rove makes it seem more political than prosecutorial (or persecutorial, in this case). Someone has to step in and provide some sanity, Fitzy looks more and more like he is suffering from BDS.
I believe this "new" grand jury was impaneled after the Libby indictment and don't know who long they can serve. I'm sure there is a time limit but have no idea what it is.
I worry they are from the belly of the liberal beast, DC, and as the saying goes, "will indict a ham sandwich".

The only thing I know about the current grand jury, is that it is handling other things, and is not just dedicated to the Libby case, as I believe the other one was. I do recall from the presser, that Fitzy said everything would be finished in a "few months", but then that was before Woodward stepped forward and said WHOAH FITZY, I was told about Plame by someone, not LIbby. Fitzy knows who the leaker is and is protecting that individual for some reason. I still don't get it; Libby being persecuted for "lies" when no crime was committed (protection of UGO for leaking Plame's name). It all boils down to the seeming fact that this whole incident is a political witch hunt by Fitzy, in coordination with Wilson and the DNC.
Oh well, if it goes to trial, I will look forward to seeing Dim Russert on the stand with video's being played of the many lies he has told on MTP, to show the jury, that Russert is the liar.
I do have the justoneminute site bookmarked and read it daily. They do have an "ear to the ground" on the Libby deal.
This should be an interesting election cycle. Fun to watch.

I wonder how many times Fitzgerald wakes up at night, in a cold sweat, with the thought, "What if Joe Wilson is the liar"?
