The mother of a U.S. Marine was grieving for her dead son when she found that his savings account had been claimed by the director of the funeral home.
It was money that he had no right to and despite a court ruling, the funeral director refused to pay.
What's even more puzzling is that he's not just any debtor, he's the mayor of the small town and a member of a City Council that has financial responsibility for the city's budget.
7NEWS also found that he has other debts as well, something his constituents may want to know.
Jason Sepulveda, a Marine, was training at Camp Lejune in North Carolina, preparing to go to Iraq, when in an evening off-base, he was killed in a car accident.
Records show that the funeral was paid, in full, by the Marines.
But after closing out her son's accounts, Jason's mother realized that the probate court had sent the proceeds of Jason's savings account to the funeral home, which is run by Jim Bostick.
Sepulveda took Bostick to court ...
The judge's order ...gave damages, interests, court fines, everything...
But despite the judgment of more than $7,500, Bostick has refused to pay.
Court records show Bostick has several current unsatisfied debts to creditors from Greeley to Montana and that doesn't include money he owed when he filed bankruptcy in 2001.
"My son was in the Marines and he went there to do what was right for his country.
I know for a fact that for somebody to actually steal from him is not right," ...

This was my son's money and I'm not going to go away."

Uh...you can do this, at least right up to the moment when the judge has you hauled off to jail for contempt of court.

Exactly. I wouldn't bother directing any efforts toward this Bostick twit, but rather inquire as to why the judge is allowing Bostick to ignore his/her order?
You can bet if this mayor was a republican, the headlines would read:
REPUBLICAN Mayor Won't Give Dead Marine's Money Back .
You'd also be able to fiqure out what his name is and there'd probably be a REPUBLICAN reference every third paragraph. So you can conclude he's a democratic given the lack of information.
This is common in debt collections. It requires the judgment winner to have her attorney take more action. Liens, forclosure, etc.
There are a lot of unanswered questions. Why was the money released to this guy? Banks have rules,right? Did he do this with other deceaseds' bank accounts? And how was it done?

This could be a good start.
Yeah, it sounds more like fraud which should have him in jail instead of, or in addition to, civil court.
Sounds as if a couple of Force Recon Marines need to pay this guy a little visit and 'splain' to him why this type of behaviour is not acceptable in this country.
I hope a prosecutor picks up on this and goes after this man for some type of larceny or fraud charge in criminal court.

It would have to be done via a court order correct? He must have sued the deceased Marine's estate.
It doen't make sense!
