DNA testing failed to connect any members of the Duke University lacrosse team to the alleged rape of a stripper, attorneys for the athletes said Monday.
Citing DNA test results delivered by the state crime lab to police and prosecutors a few hours earlier, the attorneys said the test results prove their clients did not sexually assault and beat a stripper hired to perform at a March 13 team party.
No charges have been filed in the case.

The coach quit and probably damaged his career.
And the irony is some schools actauly sponsor this type of behavior. Isnt it Brown that has the toga orgy?
The left is all too eager to trot out DNA when it exonerates their favorite poster boy or girl. But when it is overwhelmingly against something they want dearly to be true, well...THAT'S another story.
District Attorney Mike Nifong has said he would have other evidence to make his case should the DNA analysis prove inconclusive or fail to match a member of the team.
While Nifong's assistant told the AP on Monday the prosecutor would not comment on the findings, Nifong told The News & Observer of Raleigh he believes a sexual assault took place.
"I'm not saying it's over," he told the newspaper. "If that's what they expect, they will be sadly disappointed."
North Carolina Central University, where the alleged victim is a student, said after the results were released that the prosecutor would appear at a campus forum on Tuesday to discuss the case.
"The truth is if you speak to crime lab directors, they will tell you that in only a relatively small number of cases is there any DNA evidence," said Peter Neufeld, co-founder of the Innocence Project.
Cheshire said even if the alleged attackers used a condom, it's likely there would have been some DNA evidence found suggesting an assault took place. He said in this case, the report states there was no DNA on her to indicate that she had sex of any type recently.
"The experts will tell you that if there was a condom used they would still be able to pick up DNA, latex, lubricant and all other types of things to show that _ and that's not here," Cheshire said.
Stan Goldman, who teaches criminal law, evidence and criminal procedure at Loyola Law School in Los Angeles, said the DNA results don't mean that Nifong can't go forward with the case _ but the test results make a successful prosecution much harder.
"Isn't the absence of DNA evidence, given the way the victim has described the crime, in and of itself almost enough to raise a reasonable doubt?" he said. "That's all the defense has to do."
Did I read somewhere that test concluded that the woman didn't even have sex???? Did I read that right?
You might remember several years ago that there was a black man who entered a McDonalds in Pennsylvania and shot every white person he saw. There was a black woman there and he told her that he was only shooting white people. He was captured and it as later reported that the Sheriff balked when asked if it was a hate crime. The bottom line here is that there is a double-standard. And it is the LEFT who is perpetuating it!!
-----"The truth is if you speak to crime lab directors, they will tell you that in only a relatively small number of cases is there any DNA evidence," said Peter Neufeld, co-founder of the Innocence Project.-----
Um, if this is true...which I seriously doubt...why is Neufeld telling us to ask "crime lab directors"??
Why doesn't he just state unequivocally, based on HIS OWN EXPERTISE, that "in only a relatively small number of cases is there any DNA evidence".
Sounds like "expert witness BS" to me.
The not-so-clever leach demographic at work building the Republic's tomorrow.
First time I ever heard someone get called a whore for not having sex :)
not the DNA test itself, but the rape kit the hospital administers to people claiming to be raped
It can't show if someone has had sex or not, it can only show the presence of genetic material.
The evidence she didn't have sex had to have come from medical reports.
"Attorneys Wade Smith and Joe Cheshire said the tests showed no DNA from any player was found on the woman, her clothes or her belongings. The medical results showed the woman hadn't even had sex, the attorneys said."

I'd wager that ninety-nine out of a hundred condoms sold in the United States is latex. Care to take me up on it?
~ and doesn't Duke have several programs studying new chemistry.
Now you're just getting plain silly. Exactly what are you suggesting? That these lacrosse players whipped up some sort of homemade condoms in the lab for the purpose of getting away with rape? What the hell? They're jocks; do you really think they're that hard up for sex?
Until the state dismisses the case there's gotta be some there there.
In the first place, there is no "case" to be dismissed; no charges have been filed. In the second place, for crying out loud! As if nobody has ever been falsely accused of wrongdoing in this country. Just ask Steven Pagones. As if no prosecutor has ever been motivated by political concerns rather than the facts. Just ask Ronnie Earle. Ask both men just how much "there" is there.
Sheesh. So let's see. We have two options: one, the stripper made the whole thing up, or two: every one of the lacrosse players at that party is lying to investigators, despite the severe criminal sanctions it could bring down on them, to protect a few rapists. Said rapists committed said rape with supercondoms they brewed up in a chem lab. Despite violating the trifecta, and despite having beaten and strangled this woman, they didn't leave a single scrap of DNA behind. Photographs of the woman showing injuries and drunkenness pre-party, and banging on the door while smiling and laughing to be let in, have some sort of explanation. The other stripper made a 911 call to complain of being racially insulted, apologizing to the operator because she wasn't sure that it was really an emergency, but just plumb forgot to mention that her friend had just been viciously beaten and raped... little details like that can easily slip someone's mind.
Which explanation seems more likely?
As an attorney, former Div 1 player and now Junior coach, I'd like to comment: Everything wrong with Universities today can be found in this one story. Div 1 Lacrosse has the highest graduation rate in college sports.
First the p.c. (I prosecute white boys too!) wing nut prosecutor publically expressed confidence in a case barely under investigation(the buffoon still thinks he has a case(LOL)!
University president puts out p.c. comments that prejudice the criminal charges and slander the young men entrusted to him. Next he fires the coach (a super guy, who I played against for years). No doubt Pressler knew what kind of "can't we get along with our multicultural community" cowardly bureaucrats he was dealing with.
Then the knee jerk ultra liberal campus newspaper and all the campus feminists, who consider lacrosse barbaric (and the players barbarians), come out of the woodwork and make all the papers.
Then the professional race baiters come out to rally and capitalize.
These clowns in the Duke administration get what they deserve. I hope all 47 are on scholarship elsewhere playing in 07' and that Duke Lacrosse never returns. The University doesn't deserve it! On the other hand, neither do any of the other D1 lacrosse schools: most are top east coast academic schools, with left wing agendae, who would act the same way as Duke.
Kudos to the parents for keeping mum!
In cases involving gang rape there is DNA and also other physical evidence. Nothing happened here; not remotely possible; its A HOAX.
Just some P.C. buffoons getting caught Tawana Brawley style and not men enough to admit it (University President, Prosecutor). JGS Esq.
Your bigotry speaks volumes about yourself.
The "State" is a less-than-stellar county DA, who just happens to be up for re-election. Don't hold your breath.
Blasphemy. The only man who scares Chuck Norris is Chuck Norris. But if he messes with himself he knows he can disable himself with a roundhouse kick to the head.
Are we sure the defense is releasing the DNA report? I just thought it was a statement.
Lots of DA's are frequently up for reelection. I doubt they'd file without any evidence just because they might want to get reelected.
The word that I haven't seen used in this story - but should be - is "lynching." What we've seen here by the media and the "legal commentary community" and the race hustlers, is a modern day lynching.
You'll recall Clarence Thomsas' use of the term "high tech lynching" during his confirmation hearings...
That is poetic. Absolutely deep.
