High School Kid Who Burned Mexican Flag Arrested And Charged With Arson

Just got home from work, and was listening to Joe Crummy on KFYI interview one of the dads of the kids that burned the Mexican flag:

Apparently, his kid was arrested by AJ Police and was held in detention in Florence all day yesterday. CHarged with Arson. It took all of their savings to get a retainer for an atty.

It gets better. The family is now getting death threats. They were informed by police that there are those trying to find out where the family lives, and are going after them. AJ police stated to the father, there is nothing they can do about it, until someone actually shows up on their property.

Also, there was another kid from the school (Rod, who said he was a "future" Marine) read that letter from the school, forbiding any kid to wear any article of clothing resembling or representing a flag, no matter what country it represents.

He said emphatically, that he *will* wear the US Flag to school Monday.

Apparently this flag burning was near the ROTC table.

My respect for the kids in AJ have grown a hundred fold!

Glad you reminded me of that! Unfortunately, in today's baseball world, if a ballplayer did that same thing, especially with a liberal like Bud Selig in charge, that player would be suspended and forced to attend sensitivity training classes.

As noted, there are unquestionably variations in the required elements of the crime from state to state. In MO, for example (iirc), an arson that threatens the lives of the occupants of a building is termed ''first degree''. The intentional burning of an unoccupied building is termed ''second degree'', but is still arson.

Technically, it makes no difference. The Mexiweasel, although certainly traitorous, has not been convicted of any offense and still enjoys the protection of statute.

In reality, I rather doubt the prosecution can find 6, 9, or 12 people sufficiently besotted to vote to convict for what is, again technically, arson.

A flag is still someone's property, and the defintion of arson thus applies.

What you meant to say was ''Under federal law, the proper way to dispose of a the flag of the United States is to burn it.'' Your formulation would include criminal penalties for burning ANY flag, which is simply risible.

At law, burning the flag of the United States falls under 18 USC 700, and is a separate misdemeanor punishable by a fine of up to $1000 and/or 1 year in prison.

I wonder if charging this kid with a crime is going to effect his ROTC, or later getting into the service?

That would really piss everyone off.
