The courts have too much power! No one is listening to me on this.
Judicial Review isn't in the Constitution - thus there is no real check on it. Congress can (theorically) pass a law to go around a decision, but it only takes one lawsuit to throw out said law.
The judges are the new aristocracy and O'Conner's statements prove it.

Retired judges often sit on cases where private parties pay rather than keep it in public court.
They can sit on cases perhaps involving millions in judgments.
She could be made a temporary appointment and so forth.
I though she wanted to care for a dying husband. Maybe he is on the way out already.

She could be making retirement more relevant and interesting for her husband. But evidently she's married to the law and doesn't plan on getting a divorce soon.
Marriage doesn't seem to mean the same thing to the liberal intellectual elite as it does to a lot of people in this country.
