Judge Says Disposed Fetus, Tissue Isn't a Person

SANDUSKY (AP) -- A hospital whose employee stored about 90 fetuses or fetal tissue instead of disposing them didn't violate the law, said a county judge, citing the U.S. Supreme Court's Roe v. Wade abortion rights ruling. Erie County Judge Tygh Tone ruled against extending the definition of "person" to include fetal tissue based on Roe v. Wade, which set a precedent that legal rights of a "person" have "generally been contingent upon live birth."

The judge dismissed four claims in a lawsuit against Firelands Community Hospital, now known Firelands Regional Medical Center. Two women who had miscarriages or stillbirths at the hospital filed a class action lawsuit against the hospital in 1997, claiming the hospital committed fraud because the staff did not tell them how the fetal tissue would be disposed (...)

"Lukas was simply trying to balance her own religious beliefs with the requirements of her job," the judge said, citing Lukas' court brief. "However, Lukas' religious beliefs that fetal tissue should not be placed in the grinder may be in conflict with religious beliefs of the plaintiffs."

My sister had a stillborn child in the 5th month of a pregnancy. She had the baby buried in a family plot.

Now this judge says that if the hospital had taken the fetus and ground it up she wouldnt have been able to claim it and give it a burial?

Having asked that question. I didnt know they ground fetus's
I assumed they were cremated. Grinding up a fetus is ghastly, ghoulish, almost like Saddam throwing people in mulchers. Geez. What is the matter with people who dont ask whats going on with their babies?

It's also funny how a baby that is born prematurely is a person while the same baby remaining in the womb for another month or two is a piece of tissue.

That's what imagination is for. If you have kids, you understand the almost painful precision that they put into "I'm not touching you." This is a legal version, of sorts.

That's whacked. I'd side with Lukas. I assume the grinder is typically intended for other biological waste? I would think common decency would steer people towards cremating stillborn babies rather than putting them in a grinder.
