Two plead guilty in man-boy sex case

FBI sting led to several arrests

Two members of a group advocating sexual relationships between men and boys pleaded guilty in San Diego federal court yesterday to sex-tourism charges.

Phillip Todd Calvin, 44, a Dallas dentist, and Paul Ernest Zipszer, 40, a personal trainer from Deltona, Fla., were arrested in San Diego a year ago in a sting initiated by an FBI agent who infiltrated the North American Man/Boy Love Association, also known as NAMBLA.

As part of a plea agreement, prosecutors asked a federal judge to sentence the men to no more than two years in prison followed by 12 years of supervised release, a condition similar to parole.

A third man arrested in the case, David Cory Mayer, 50, a Chicago flight attendant and psychologist, remains in custody without bail. A judge has not set a trial date.

Mayer's lawyer is arguing before U.S. District Judge Jeffrey Miller that NAMBLA is a political organization protected by constitutional freedoms of speech and association, and that federal agents illegally infiltrated it to “instigate” crimes.

Lawyer Benjamin Coleman also is arguing that the undercover San Diego FBI agent who joined NAMBLA and attended two conventions had no probable cause to suspect criminal activity and shouldn't have been allowed to join.

Prosecutor Anne Perry said the agent acted appropriately.

The now-retired agent, Robert Hamer, testified yesterday that he joined NAMBLA in 2001 while investigating a Los Angeles travel agency suspected of arranging trips to Thailand for men seeking sex with children.

Hamer said he wanted to understand the mind-set of such men in order to better impersonate one.

“We were not investigating NAMBLA,” he said.

Hamer said that as part of his membership, he participated in a program in which the organization sends holiday cards to incarcerated members and attended a convention in New York City.

In 2004, he attended a convention in Miami, where he talked to several members about traveling overseas for sex with boys.

Eventually, seven men signed up with a bogus travel agency the FBI set up and arranged a trip to Ensenada. They were arrested as they prepared to board ships in San Diego and Los Angeles, according to court documents.

An Orange County man also was arrested on child-pornography charges by Los Angeles agents in connection with the investigation.

Four of the five men charged in Los Angeles pleaded guilty, with the longest sentence being 14 years in prison. The fifth man was convicted by a jury and has not been sentenced.

Do you claim the country the child rapists were intending to travel to and rape children do not have laws against raping children?

I don't know the answer to that, however, it is the responsibility of that country to prosecute.

This is a slippery slope and can have a lot of unintended consequences.

Bullet in the head is needed.

Notice how the FBI man was scolded for even investigating NAMBLA or joining. By the defense laywer, of course. How could anyone be a defense lawyer for NAMBLA scum?

I am not making a morally equivalent comparison.

I am pointing out that it is equally a FELONY under Federal law to have powerful fireworks. Thus, while I support the attacking of NAMBLA, it is only being intellectually honest to point out the slippery slope this kind of thing is establishing.

The only thing slippery or a better term would be"slimy". is your bending over backwards to equate personal freedom with criminal predatory actions.

Perhaps the FBI should have just informed their counterparts in the foreign country destination of the rape plans of certain USA citizens to target their nations children, and wash their(our) hands of the whole repugnant incident?

I could live with that, as long as the rape plans were squashed prior to implementation, and you don't also demand the USA "do something" to help these noxious citizens avoid the cruel and unusual punishment the foreign country deems fit to meet out.

Is that a deal?

Absolutely that would be the right way to do things. They would have been refused entry to the country in question.

The simple fact is that US jurisdiction, does NOT extend outside the borders of the USA and its protectorates, territories, or areas that are under military control; and that is the way it should be.

Perhaps I should give you another example: the SEC claims that any stock or bond issue, issued anywhere in the world, that could conceivably be owned by an American, falls under their jurisdiction. So an Italian bond issue, that an American purchased on the Italian bond market, even if he was living in Tuscany, the SEC claims jurisdiction over. Is that acceptable to you? Is that the way a limited government operates?

That is my point though, in that the US is trying to establish its jurisdiction beyond its borders.

The US has a long history of asserting jurisdiction beyond our borders especially in matters involving unalienable rights which the founders recognized come from an authority that supercedes the State. Our basic human rights and freedoms do not come from the State...

What it comes down to in US decisions that involve interceding to make right something wrong involves weighing competing interests and deciding to sit back or take action.
