Special Prosecutor Accuses Former Cheney Aide's Legal Team of 'Greymail' In the latest legal wrangling in the CIA leak investigation, Special Counsel Patrick Fitzgerald pushed the judge in the case to deny Lewis "Scooter" Libby's defense team access to scores of top secret documents it had requested.

Last month Libby's defense team also gave notice to Judge Reggie Walton that it intended to subpoena journalists in the case.
And...
The document filed by Fitzgerald indicated that the grand jury investigation into who leaked Plame's name is still ongoing. A status hearing in the case is scheduled for Feb. 24 before Walton.
If the prosecutor is using these documents to prosecute Libby, then Libby has the right to see them. How can he defend himself otherwise?
What is Fitz trying to hide? Was does he refuse to turn over any documents relating to Val's (alleged) classified status or the damage done from any disclosure?
One guess is it would show no underlying crime and no motive for alleged perjury.
Fitzgerald doesn't have a case and is acting unethically. After this is over he should be referred the the Bar for disbarment. He is just as bad as that idiot in Austin Texas.

Libby can't get a fair trial unless he has everything the prosecution has...
Fitz had no problem at his press conference saying that Val was classified and implying the CIA was harmed by the leak, but he refuses to provide any documentation to support those claims. He was afraid to put it in the indictment, but he had no problem saying it on national TV.
Also in his response to Libby's doc request, he accuses the defense team of 'greymail':
"It is respectfully submitted that in addressing these discovery requests, this Court be mindful that the incentive for defendants facing trial to engage in greymail to seek to derail a trial is so well recognized that Congress passed the Classified Information Procedures Act statute (CIPA) to deal with it."

Fitz only likes it when his side of the story is told.

And that will keep Novak from publicly naming him.
Before Fitzgerald forced him to resign, Scooter Libby held one of the top posts in the country, and I'm sure had a very high security clearance.
Fitzgerald is a mid-level prosecutor, for all his current fame. Is his security clearance as high as Libby's? Has he been as thoroughly backgrounded?
I doubt it. Now he's trying to say that the assistant to the Vice President can't be trusted with classified documents?
Let's not forget that Libby is an attorney, and I'm sure has a top notch legal team to represent him. I'm not sure I'd want to be Fitz at this point.
I AGREE .. the guy never even investigated the issue - who released the name. My goodness - I thought this guy was supposed to be such a hot shot - evidently not!

...and also would expose the fact that there is NO REASON to continue the investigation!
Fitzgerald has been involved in the most major prosecutions of terrorists that have occurred. He most assuredly has an extremely high clearance just from prosecuting the WTC1 attack.

Am I the only one that reallly dislikes this guy. A little off topic here, but I can hardly stand to watch when he comes on Fox. Why ever did they want him?
