Actually, premeditation does not mean a complicated plan, only a plan to commit murder, even seconds ahead of time. Telling the man to get up, knowing it'd look more like a self defense if he was getting up, could be argued as premeditation.
I had to watch the video twice. But, the second time, it was clear he was told to "get up" and then he was shot. He's lucky there was someone with a video camera nearby.
I think the Sheriff's deputy was telling him "Don't get up"

Perhaps a little racism is at play? The soldier was hispanic, I havent seen the video as I have a poor connection, is the deputy white?
No matter who was driveing, without either seeing a weapon or hearing a verbal threat from the suspect, the cop was way out of line.

I normally do support the cops, they have a tough job. But this was so far over the line it's indescribable.
I watch "Cops" on court teevee once or twice a week. In easily 75% of the arrests they make of a previously fleeing perp (knowing full well that the cameras are running) they continue to beat on the perp well after he is subdued and/or cooperating. The same is true for most live telecasts of car-chases.
I empathize with the cops frustration and anger, and most of these of these perps deserve (INO) slapping around a bit for what they did, but excessive force is excessive force.
We had a guy here in FT. Walton convicted of pre-meditated murder for making the decision to kill a person just walking from one end of a mobile home to the other. "Advance" can be a very short time.............
Sounds like the LEO was enraged that someone would DARE to try to evade him and totally lost control of himself. Take him off the police force and never let him carry a gun again.

well, every case is different of course. this fellow was certainly not fleeing.
honestly, I would not know what to do either if someone holding a gun on me gave me two orders that were directly at odds with each other.
The kid clearly tells the Deputy, he "means you know harm", he tells him he's on the Deputy's side and is military. The Deputy clearly tell the kid to "get up" twice. The kid responds twice he is getting up. Then the Deputy shoots him.
For a fact, althought there are some unbelievers out and about, most cops will call them like they see them. When they are involved and the liability is heavy they are not going to say much of anything about an incident. They have that crammed into them in the academy and by police lawyers all thru their careers. Use the 5th Amendment and Miranda as the more you say the more something will come back to haunt you, even if you haven't done anything wrong.
But this video is pretty damning and I'd say this Deputy had way too much adrenalin pumping and wasn't thinking. Still I'd want to know the whole story and interview everyone involved before a final call is made. Afterall, all of the details have to come out, no matter if the Deputy bites it on this shooting. Such a shame for everyone involved.
What's the standard line? "I thought the perp was reaching for a weapon!"
