Jan. 13, 2006 Today, according to Pakistani military sources, U.S. aircraft attacked a compound known to be frequented by high level al Qaeda operatives. Pakistani officials tell ABC News that al Qaeda leader Dr. Ayman al-Zawahiri, Osama bin Laden's top lieutenant, may have been among them.
U.S. intelligence for the last few days indicated that Zawahiri might be in the location or about to arrive, although there is still no confirmation from U.S. officials that he was among the victims.

U.S. Airstrike Targeted al-Qaida Hideout
by RIAZ KHANDAMADOLA, Pakistan - An airstrike in a remote Pakistani tribal area on Friday killed at least 17 people, and a senior Pakistani official said the target was a suspected al-Qaida hideout that may have been frequented by high-level operatives, possibly the No. 2 leader Ayman al-Zawahri.
Citing unnamed American intelligence officials, U.S. networks reported that it was a CIA strike and that al-Zawahri, Osama bin Laden's top lieutenant, could have been at the compound in the Bajur area or about to arrive.There was no confirmation from either the Pakistani or U.S. government, but a senior Pakistani government official told The Associated Press that "there is 50-50 chance that some al-Qaida personality was at the home" that was hit.
The official, who spoke on condition of anonymity because of the sensitivity of the issue, said that he had heard that the al-Qaida figure may have been al-Zawahri and that the information would be clearer later Saturday.A service of the Associated Press(AP)
Believe it our not...I turned the radio to Hugh Hewitt a minute ago...and he has on Irwin Chemerinsky who testifed vociferously against Alito today...
and was adamant that Alito's views on Presidential powers is all wrong.
Hugh asked Chemerinsky if he had a problem if this strike on Zawahiri by the CIA was ordered by Bush..WITHOUT a warrant....(he was being sarcastic, I am sure)...
But, Chemerinsky didn't catch the sarcasm...and gave a long assed answer...but basically said that since Zawahiri was a "known terrorist" around the world...it is probably OK!!!
