Day 4: Hearing Resumes

This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

Mrs. Alito shakes her head as Fatboy states the number of shares Alito had/has in Vanguard.

I went back to that moment using Real Player, and I saw that too. She must be seething, and using every ounce of strength to control it.

No kidding. Vanguard was going to give the money to one of the parties regardless. This was not a case of Vanguard having anything to gain financially.

Leahy is senile..or close to it..nearly incoherent..and his questioning, er, rambling..is pathetic. I predict that after Alito is confirmed by the Senate, you will hear lots of talk on the left to get rid of him as the ranking member..

Judge Alito is very definitely shaping up to be my favorite SC Justice. But I'm not so sure about Chief. Maybe I'll change my mind later. Both Roberts and Alito are brilliant men and will make the kind of justices that will give President Bush the kind of legacy that Clinton could only dream about. But I think, maybe, that Roberts will be the better Chief. Alito is a law "geek" and likes to go into extreme detail, even in these hearings. Personally, I love to listen to him. But it takes a different kind of talent to get people to talk and come to a consensus. I think Roberts showed a better talent for that. But having justices on the court like Alito will help Roberts be a better chief.

That's a small part of it for certain.

But consider since Bork conservatives have spent years debunking the sting of the type of accussations that helped derail Bork. Alito, and Roberts, benefit from about 18 years of groundwork to ascertain what happened to Bork, and to lesser extent Thomas, cannot be successful again with the American people. That and the difference in Alito's temperment vs Bork are significant factors as well. Unfair temperment was used to derail Bork? Absolutely in his case. But we know the egos of the Congress are such that if you are combative against them you've made an enemy. Not so good when their vote is needed. Unfortunately as a result we got Kennedy eventually for the slot.

He has absolutely no idea how completely pointless these questions are.

Does he really think that after 3 days of testimony that Judge Alito is going to say, "Oh alright. You got me! Boy, I had you all going, but with your relentless asking of the same questions over and over again you finally wore me down!"
