This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

I don't have any problem with him saying he should look at precedent. He should look at it. He also said it wasn't an inexorable command. Looking at precedent does not mean he has to follow it.
I heard Leahy's remarks...and his condescending attitude after he stopped...
Did Durbin and other dems us the same language as Leahy...like perhaps they planned to make these statements together?

true story: i saw him at the Shrine of the Immaculate Conception in DC when i was chaperoning my then kindergarteners field trip there (catholic school, obviously). He was there for the opening of the John Paul II center. i commented to the other parents how i was fully expecting a lightening bolt from on-high to just zap him in front of my eyes, on the steps. he was literally just about 10 feet away. i feel so deprived that it did NOT HAPPEN!!!!

I am very sorry for you and for your son or daughter. That's something that you never get over completely.
My parents' first pregnancy, they went to the hospital come delivery time. However, in those days, doctors didn't have the resources available and the baby was strangled by the umbilical cord and never made it. They didn't name her officially (my father said that people didn't do that in those days). But she is buried in an area of the cemetary that is set aside for babies. I think that it is Sacred Heart, as the graves are buried to shape a heart. Recently, my niece asked what her name would have been. "Lucy" , my mother told her. So whenever she is around she will say to my nephew (her cousin), "Hey, let's go visit Aunt Lucy!" And then they tidy up the grave.
There are a lot of empty spaces, in part because science helped us so much, but also in part because of your experience.

Looks like blogger Liz Aloi doesn't want that on the record. I did say that they pretty it up. Usually it means cleaning up after the Dems. Although a couple of the guys blogging were great.
No question they're huddling to discuss the feasibility of that right now, like you pointed out. I think they will conclude, however, that they will need something else to make a filibuster a politically viable option.
I'm wondering if we won't see an Anita Hill come slithering out from under a rock sometime tomorrow, just in time to get booked on all the Sunday shows and give the Dims an excuse to demand more hearings?

4:58: Senator Cornyn points out that Alito has disagreed with his colleagues before so there is no reason to think that their testimony today could lead to a conflict of interest. He points out that sitting judges providing testimony like this is not unprecedented.
4:55: Sessions points out that Congress messed up Rybar, not Alito. Laughter (agreement?) in the room. Sessions is asking whether or not throwing rocks at people is a federal crime. Lots of chuckling. Judge Lewis points out that rock throwing could be a civil rights violation.
4:53: Senator Sessions remarks that Alito's civil rights opinions have almost always been unanimous.
4:53: Senator Durbin is up and agrees with Senator Leahy on the inappropriateness of questioning sitting judges. Senator DeWine has no questions for the panel.
4:50: Senator Kyl is asking for clarification on the 3rd Circuit's policy of distributing 3-judge panel opinions to the whole court. Not every Circuit does this.
Judge Scirica is clarifying. They only circulate precedential opinions, or non-precedential opinions with a dissent. Therefore precedential opinions are sent to the court twice - before and after publication.
Kyl is asking what happens if a Judge disagrees on the initial circulation. The Judge can write to the opinion writer or the entire court expressing his/her disagreement.
