SALT LAKE CITY (Jan. 10) - Utah's oldest inmate, 99-year-old Bert Jackson, will be paroled and serve the rest of his sentence on home confinement.
Jackson has served three years of a sentence of one to 15 years in prison for sexually abusing at least two children.
"I don't want you to die in prison," state Board of Pardons and Parole member Keith Hamilton told Jackson during a Jan. 3 parole hearing.
The Board of Pardons decided Thursday that Jackson will be paroled Feb. 7 to live with his son and daughter-in-law.
The parole hearing lasted longer than usual because Hamilton, speaking in a raised voice, had to repeat nearly all of his questions to Jackson, who is hard of hearing.
"You're in pretty good health for a 99-year-old man," Hamilton said. "We don't want you touching anybody anymore, OK?"
Jackson was 96 when he was sent to the state prison in November 2002 after pleading guilty to two counts of child sex abuse stemming from incidents in 1995 and 1996 in Lewiston in Cache County.
Jackson may be Utah's oldest inmate ever, said Jack Ford, spokesman for the Utah Department of Corrections.
Jackson may not leave his son's home except for a doctor's visit or for a medical emergency. He will wear an ankle monitor. Parole lasts at least three years.
In a letter to the board, Jackson's son and daughter-in-law promised to keep him away from children, Hamilton said during the hearing. He said the board may allow Jackson out of home confinement if he abides by the parole agreement.
"You're too old for being interested in little kids," Hamilton said.
"I'm sorry for what I ever done," Jackson said.
That apology was the first time Jackson acknowledged his crimes and was listed among the board's reasons for Jackson's release.
The board also took into account that this was Jackson's first incarceration, that he has been well-behaved, that he is 99, and that he has a support system and solid release plans.

What is there to say to that? I don't know.
He should die in prison. His victims have a life sentence, why not him?

As long as he doesn't come in contact with kids, let him die at home. It isn't likely he'll be climbing out the window or anything.
Rather amazing that the evidence stood up in court.
What's the legal age limit on that again? Someone remind me... =P

Why would we not want this man to die in prison? What possible reason is there for giving a multiple child sex offender a pass on anything?
It's cheaper for him to die outside of prison.
If he dies in prison, the prison has to provide a funeral, grave, etc. Not to mention medical care for whatever final illness kills the old pervert.

he's being given a pass because the bureau of pardons and parole can't do the right thing - you see they ain't got the balls, and rather than do their jobs, they would rather feel good about themselves. Was there ever a time when adults were in charge of anything around here???
But on the outside, won't we also now be providing him with Social Security and Medicare?
And why not? He only served 3 years for actions that may affect his victims for the rest of their lives. He's going to stay with a family and how are they going to guarantee that he will never be around children?
I have no problem with my tax dollars going for that. Plus, I am sure I am paying for his medical care no matter where he is living and probably the funeral also.
He should never see daylight again.

What? This guy needs to vacate his seat along with that judge who gave 60 days to another child molestor. We don't need wimps like this when our children need protection.
