Yeah. LA Lies had to cut staff so they fire one of the 3 Conservatives on staff. Glad he landed at Investor's Business Daily. Anyone know anything about IBD? I may have to start reading it now.

It's not his premise, it's the Supreme court (and many other courts) ruling that Congress cannot limit an inherent Constitutional power by legislation. Congress cannot amend the Constitution by legislation, only through the specified amendment process.

His premise boils down to admitting any warrantless wiretap without oversight under the aegis of "wartime power."

I do concur with your point, that inherent powers of one branch can't be totally usurped by another, and that the Constitution can't be amended or abridged by legislation. But that general principle doesn't get to the meat of the analysis.

The argument therefore has to be whether the power exercised is inherent and stems from the President's constitutional authority or whether it is derivative of that power. A derivative power can be "channeled" by legislation, but an inherent power cannot be limited.

Okay. You've introduced the terms "derivative" and "channeled." I can imagine that one man's "channeled" is another man's "limited" though. Which simply points out that without a fact based inssue in front of us, talking in the abstract is easily misconstrued to each listener's preference.

All of the case law, and even the FISA law itself, specifically states that it cannot abridge the president's power in this regard.

What regard, precisely?

Clinton even used this power for purely domestic warrant-less wiretaps after the OKC bombing. That makes this settled law.

I hadn't seen a reference to warrantless domestic wiretapping in the wake of OKC. Can you point me to further information on that? As far as an action being settled law, the fact that an action was taken doesn't make it settled law. Lincoln denied habeas to Milligan, and that wasn't settled law until afer the war. Lincoln's action was found to be unconstitutional.

That must be an old picture, he is after all pushing 60. He is still a nice looking fella, and has worn well in the Den of Dragons called the House of Representatives.

Pat is psychotic, I agree,but Peter Fenn can be totally unscrupulous and appear to be such a "great guy" to an unsuspecting audience. He is one of the worst kinds of dems IMHO. Great takes.

It's just that pathetic pack of political ponces that parade about DC in the RINO costumes that doesn't.

Those congressmen and senators and administration hacks who, come feeding time, when they are all lined up at the trough - but that they wear Republican colors and pose as Republicans - are absolutely indisinguishable from anyone else in town.

I trust Novak to be Novak. He seems the same to me now as he has over the years. He's an admitted Democrat who happens to be more conservative than most of them. If he seems conflicted, that's probably the reason. Well, that and he gets less tolerant as he's gotten older. LOL

He is very smarmy. He is cranky. Very few people like him.

Unfortunately he does very good research on house and senate races and has an excellent track record. In the 94 election, he had it down to the seat where others were doing a lot of projections/wishful thinking.

But he is someone I would not want to do business with.

Does anyone know if Harry Reid and the Democrats have yet given Dennis Hastert a list of approved Representatives to replace DeLay?

If not, I'm sure a list is being compiled.
