HOw often does it happen like you so eloquently stated? How many appeals judges play it straight?

Most. Go to any law library and you can read hundreds of thousands of cases. Appeals judges do NOT operate independently. The work in 'packs' of 3 or more. Often all 3 judges will write opinions but I think there is always one for the majority.
