Just announced on Fox News, the Justice Department is going to investigate leaks pertaining to Goverment Wiretapping and Security programs.

As I understand it there is no protection accorded to anyone in any occupation for leaking classified information which is clearly a crime. On the other hand, a "whistle blower' is sometimes granted immunity if he goes to the appropriate legal entity (e.g. the Senate Intelligence Committee, etc.). It becomes a little ambiguous when the leaker is not a journalist but one who gives the journalist the information. The leaker is guilty but is the leakee?

The existence of "keyword" surveillance of international communications is not classified information ... There is no dispute that NYT published, nor is there dispute about the contents of the publication. If said publication is a violation of 18 USC 793(a)(3), then indictment can occur independently of any investigation into how the NYT obtained the information.

793, and 794 for that matter, does not require the information be "classified" only that the information be "connected with national defense" and the release of it could be "used to the injury of the United States or to the advantage of any foreign nation."

Most of the espionage that goes on in the U.S. is culled from open sources. Disparate, unclassified bits of information are collected and assembled to produce useful intelligence. True, it is no secret that the U.S. engages in signals surveillance. But it is to the advantage of the terrorists to have it confirmed, to gain further information about which calls were being monitored, and gain comfort from the furor that has erupted. The feds need to demonstrate that the U.S. was injured by the revelation. They've been loathe to prosecute these cases. This is the perfect opportunity to change that.

Personally I don't give a damn who did the leaking, GOP or a Dimwit, doesn't matter. I would LOVE if they could be charged with Treason [wishful thinking], however, I want them in jail ASAP no matter what the charges.

Also, it seems to me that PUBLISHING TOP SECRET infomation that AIDS the enemy and causes grave damage to the security of the United States, can NOT be sheltered and/or excused by the 1st Amendment!!

The leaker is guilty but is the leakee?


What if the leaker was himself a member of the Intel. Committee? Is it possible that a lib Senator or Congressman could go to jail?

Leahey is still in office; shouldn't he have been locked up for his leaks?
