Personally I don't give a damn who did the leaking, GOP or a Dimwit, doesn't matter. I would LOVE if they could be charged with Treason [wishful thinking], however, I want them in jail ASAP no matter what the charges.
Also, it seems to me that PUBLISHING TOP SECRET infomation that AIDS the enemy and causes grave damage to the security of the United States, can NOT be sheltered and/or excused by the 1st Amendment!!
Unfortunately we can't actually charge a leaker with 'treason' because a declared 'state-of-war' does not exist ! I know there have be 'legal eagles' here on FR (and elsewhere!) that say the congressional resolution that authorized military action against terrorist (The post-9/11 resolution) is the 'equivalent' of a declaration of war. However I just don't buy that!)Of course I do not have the benefit of a legal education!) I think you would have a hard time making a case of a treason prosecution with a REAL declaration of war. (Though treason it clearly may be!)
This is why back then I wanted Bush to ask Congress for a declaration of war against Afghanistan & terrorism in general ! (The new legal ground would be the 'terrorist supporting states' to be named as we find them !
This half-war & half-peace allows nonpunishable treason to grow & flourish! I guess this 'nebulous' condition made sense for Korea & Vietnam because of the potential domino effect back to the USSR! I don't think it makes sense anymore with us as the only superpower ! Besides it shows the world we are DAMN SERIOUS !
