CLEVELAND -- An immigration judge Wednesday ordered John Demjanjuk, a retired autoworker accused of being a Nazi concentration camp guard, deported to his native Ukraine.
Demjanjuk, 85, has been fighting for nearly 30 years to stay in this country.
Chief U.S. Immigration Judge Michael Creppy ruled that there was no evidence to substantiate Demjanjuk's claim that he would be tortured if deported to his homeland.
Demjanjuk can appeal the ruling to the Board of Immigration Appeals within 30 days.
Demjanjuk lost his U.S. citizenship after a judge ruled in 2002 that documents from World War II prove he was a Nazi guard at various death or forced labor camps.
His attorney had argued at a hearing last month that sending Demjanjuk back to Ukraine would be like throwing him "into a shark tank."
This old geezer is still alive?
I think that any nazi, having reflected upon their deeds of the war years, would cling tenaciously to this life knowing what most likely awaited them on the other side....
We finally manage to deport an illegal alien. Only took 30 years.
1 down, 20,000,000 to go.
This is wrong. It's one thing when Nazi soldiers went out of their way to kill innocent people or requested these jobs, but allot of these men were just following orders.
Wasn't this guy already tried and cleared by Israel?
"This is wrong. It's one thing when Nazi soldiers went out of their way to kill innocent people or requested these jobs, but allot of these men were just following orders."
That defense was thrown out at Nuremberg. "Just following orders" does not relieve one of the moral duty to not engage in acts that are morally offensive on their face, such as genocide. Demjanjuk was guarding a death camp.
"Wasn't this guy already tried and cleared by Israel?"
He was cleared of being Ivan the Terrible of Treblinka.
Unfortunately for him, the evidence that cleared him was the evidence that he was a guard at Sobibor, another death camp.
"Your Honor, I did not rape and kill that woman on 34th Street, and here's a picture of me raping and killing a woman on 5th Street to prove that I didn't!"
Hate to burst your bubble but he wasn't an illegal alien.
"Hate to burst your bubble but he wasn't an illegal alien."
Hate to burst your bubble--he was. He lied on his application to come here, therefore he entered the country illegally.
I'm not a big fan of zero-tolerance approaches to most things but I make an exception in this case. They don't ddeserve to live or die here. Throw the garbage out.
Given the Nazi reputation for enforcing military rule ,I wonder how many that post here, had they been drafted into the German army would have refused to guard ANY place they were told to.? IMHO, if the soldier was not proven to have murdered anyone, or ordered anyone murdered, He was only following orders.
One must remember, the SS did not ASK you to follow orders any more than our own military does, and the consequences for disobeying were much harsher than ours
Did this man kill Jews? Or did he just stand post at the death camps? He was sent to where he was sent. Some were sent to the fields to kill our soldiers in battle, others were sent to guard death camps. And as for following orders then well every German citizen was responsible. From the nurses who euthanized the handicapped to the people that watched the Jews and Gypsies march off to the death camps.
Allot of the German soldiers were young men just following orders. Like our young men. So unless this man was a high-ranking Nazi, just let him be.
For the record, I agree that he probably doesn't deserve to be here. However, his acquittal by an Israeli court makes further pursuit of the case look more than a bit overzealous.
You are going to get disagreements on this but I side with you. There are still those who think that revenge is the answer to getting closure. However, they will never have closure because their lives are dedicated to revenge.
"I think that any nazi, having reflected upon their deeds "
Who is accusing him of being a Nazi? He was aquitted of this in Israel after they determined that the "Ivan the Terrible" ID was a KGB forgery.
Demjaniuk's only mistake is that he pissed off someone in the Dept of Justice and that is why the 30 year old vendetta.
He is actually being charged for only "lying" on his immigration papers.
"Demjanjuk was guarding a death camp."
reference please - I believe the only charge is that he "lied" on his immigration papers.
"if nazis from WWII can be found living in this country deport them"
Reference please. I understand he was acquitted of this chargein Israel when they determined these charges were based on KGB forgeries.
PS - Why have we spent 30 years on this one case and why has the Dept of Justice failed to bring ONE CASE against any of the thousands of Communists in this country guilty of the Genocide of 100 million in the last century?
Today we have tens of millions of people who don't even HAVE immigration papers but we do nothing to them. Also, we have no idea what they did before they came here and some people don't even care.
