WASHINGTON Dec 21, 2005 A federal judge has resigned from a special court set up to oversee government surveillance, apparently in protest of President Bush's secret authorization of a domestic spying program on people with suspected terrorist ties.
U.S. District Judge James Robertson would not comment Wednesday on his resignation, but The Washington Post reported that it stemmed from deep concern that the surveillance program Bush authorized was legally questionable and may have tainted the work of the court. The Post quoted two associates of the judge.

Judge Napolitano says there are many ways for a judge to express displeasure or disagreement. This particular judge chose the only method guaranteed to generate maximum headlines.
Too bad he didn't convince some of his co-hurters to go with him.
Isn't that just typical. They rant and rave, but do nothing to fix it. The judge thinks he sees a problem (or talking points, cough) but turns tail instead of being a man.
Stinkin' hypocrite. Good riddance. It's just one more Bush appointee in a critical D.C. Circuit seat.

Reports were that this is the judge they would shop Clintonista problems to: Web Hubble had charges dismissed my this clintonista and the charges were reinstated by the Appellate Court that overruled this guy. He is extremely partisan.
I'm betting Rush's take on this judge is the correct one. This judge was one of the leakers of the 'Bush is a spy' story and the judge stepped down to abort further investigation of his leaks.
Symbolism over substance.
The MSM will report this story for a month.
They wil report Bush's November JA Polls for a year.
