"It will be recalled that the case that set forth the primary purpose test as constitutionally required was Truong. The Fourth Circuit thought that Keith’s balancing standard implied the adoption of the primary purpose test. We reiterate that Truong dealt with a pre-FISA surveillance based on the President’s constitutional responsibility to conduct the foreign affairs of the United States. 629 F.2d at 914. Although Truong suggested the line it drew was a constitutional minimum that would apply to a FISA surveillance, see id. at 914 n.4, it had no occasion to consider the application of the statute carefully. The Truong court, as did all the other courts to have decided the issue, held that the President did have inherent authority to conduct warrantless searches to obtain foreign intelligence information.26 It was incumbent upon the court, therefore, to determine the boundaries of that constitutional authority in the case before it. We take for granted that the President does have that authority and, assuming that is so, FISA could not encroach on the President’s constitutional power."

Regarding the president not getting a warrant, the NYT article states that the government DID use subpoenas for domestic taps in a great many instances, mostly related to conversations between terrorist within the US.

It might be a good time for the president to remind viewers that in the 90's, Congress was briefed that OBL was using a satellite phone and we were tracking his movements and plans.

As a result of a leak from Congress (Leahy?), OBL ditched his phone and we didn't have good intelligence on OBL's whereabouts after that. Maybe we could have prevented 9/11.

There was a guy - Congresscritter, I think, but I did not get his name - who told Kiran on Fox & Friends this morning, that CONGRESS had to renew this act every 45 days - so they certainly knew.

Didn't the President say in his speech yesterday that the wire taps were reviewed by Congress every 45 days?


From the President's radio address yesterday:

The activities I authorized are reviewed approximately every 45 days. Each review is based on a fresh intelligence assessment of terrorist threats to the continuity of our government and the threat of catastrophic damage to our homeland. During each assessment, previous activities under the authorization are reviewed. The review includes approval by our nation's top legal officials, including the Attorney General and the Counsel to the President. I have reauthorized this program more than 30 times since the September the 11th attacks, and I intend to do so for as long as our nation faces a continuing threat from al Qaeda and related groups.

I want us to get Steven Emerson to join FR; now there's someone who knows a LOT about terrorism.

He had to rent warehouses to hold all his information about jihadists in this country; then last year the FBI told us there weren't any Islamic cells here. Bah!
