Ithaca-Area Democrat Wins Election, Judge Tosses Military Ballot

ITHACA NY—A Republican Town Supervisor has lost re-election by one vote, after a judge ruled on Tuesday that a military ballot not be counted.

According to the Ithaca Journal, the decision by Supreme Court Justice Walter Relihan left incumbent, Gary Fisher of Enfield, one vote shy of his opponent, Democrat Jean Owens.

The military voter was Fisher's son, who was stationed aboard a ship in the U.S. Navy and unable to receive the ballot prior to the election. The ballot was returned to the BOE by the deadline for military ballots, with supporting documentation from a military commander explaining the circumstances. But since the ballot was not received by the voter prior to the election, the judge ruled it should not count.
The military ballot had been challenged by Tompkins County Democrat Party Chair Irene Stein.

Some political commentators have expressed concerns that the Democratic party is actively engaged on a national level in attempting to disenfranchise military voters, who are seen by many as a pro-Republican voting bloc.

They see their causes as righteous, and will claim power by any means necessary. In their twisted frame of mind, the sheeple can not decide what's best for themselves, so they have appointed themselves shepherds, and will lead us down the right path.

As a veteran, I simply chalk this up as just another example of the hypocrisy of the Democrat party. We love and support our troops, we just do not want them voting.

Depends on the local election law... I seem to remember an election here in Orange County, CA decided by a coin toss as a tiebreaker.

We love and support our troops, we just do not want them voting.

They do love the military, like they love puppies and children. That’s why they always refer to them as children sent off to war by evil Republicans who never send off their own children.

The fact that every single last soldier in our military is an adult who entered service of their own free will does not fit into their template.

They believe the military are dopey little kids, too stupid to vote, and forced into arms. But they love them, in an insulting and thoroughly condescending way. Like the blacks.

It was given prominent coverage in Ithaca, but only as a "yay, the Democrat won" and, paradoxically, how this is an example of how "every vote counts."

I think this sailor's constitutional rights were violated. What right does anyone have to know how he voted? It was the fact that they knew how he voted that enabled the Dems to get it thrown out. If they did not know how he voted, then there would have been no way they could have known that they could have altered the election by objecting to it.

THe argument seems to be that they "voted" after the polls had closed.

But in the past, judges have ruled to keep polls open AFTER closing, when they "determined" that circumstances were making it hard for the voters to get to the polls on time -- for example, in 2000 polls just in St Loius, Missouri were kept open long enough to get enough extra democrat votes for Ashcroft to lose the election.

If I were to use the ruling of the New Jersey Supreme Court in 2002, when they threw out legislatively-dictated deadlines to allow Lautenberg onto the ballot, I would say that the "spirit" of deadlines were not hard and fast requirements, but rather were simply meant to guarantee we could have an orderly election, and since the ballot was returned in time to be counted, the spirit of "letting every vote count" would override the pesky "voting date" written into the law.

But the democrats are always arguing both sides of the issues, based on politics. The Democrat party, and move-on et.al., ran a strong campaign to support "non-partisan" redistricting in Ohio, while at the very SAME time ran a strong campaign AGAINST "non-partisan" redistricting in California.
