WASHINGTON Democratic Sen. Russ Feingold said Tuesday he won't rule out a filibuster of Supreme Court nominee Samuel Alito, although he said no one in his party is actively planning to use the tactic.
"Certainly nobody I know is," said the Wisconsin senator, who is considered a possible Democratic presidential nominee in 2008. "But I'm not going to take it off the table. It's my right as a senator and it's an important right."
Senators have been jousting lately over whether the minority Democrats are planning to filibuster Alito, who was nominated by President Bush to replace the retiring Justice Sandra Day O'Connor.
Senate Majority Leader Bill Frist, R-Tenn., said Sunday he would move to eliminate judicial filibusters if Democratic launch one against Alito. Democrats in turn said they aren't planning a filibuster right now, although they refuse to say they won't try to start one.
"They cannot, as they have been doing now for more than six weeks, keep filibuster hopes alive by suggestions and hints, and then claim their political hands are clean when senators on this side of the aisle respond," Sen. Orrin Hatch, R-Utah, a former Judiciary Committee chairman, said in a statement Tuesday.

For some reason, the voter fraud in Wisconsin keeps going Russ' way. He was just re-elected in '04 so he can go full bore moonbat for a while.

Talking tough, like he KNOWS he has the votes for rule change.
Overall his record is not impressive, so I don't take his confident stance all that seriously.
a) Not sure they in fact have the votes,
b) Not sure Frist has the skill or will to do the deed.
The Rats will behave like Rats. The Republican senators will behave like Republican senators. Frist is either bluffing or confused.
Alito may be confirmed, but it won't be Bill Frist who makes it happen.
The guy who ran against Feingold last year could have lost a race against Bob Dole. Yes, Tim Michels ran that bad of a campaign.
I can't believe this guy lost after the Incumbancy Protection Act was passed. That's a shame. Bush was on the ballot, too, and you guys were really close to going red, I remember. This means that a lot of people pulled the lever for W and Fein-nazi at the same time. Perplexing to say the least.
The spineless, gutless Bill Frist had a chance to eliminate the filibster earlier in the year, but caved in to the radical RATs.
Crying wolf again.
Feingold is being talked about as the candidate of the left in 2008 so he will keep the DU types fired up by being as confrontational as possible.
So the next scenerio is procedural, and finally the filibuster.
But wait a minute, we have rinos to worry about too.
IMO, even the combination of the rats and their limp wristed rinos across the aisle cannot stop this train.
