This isn't unprecedented, although the fact that he managed to put on a condom would have caused me to lean against finding that he was asleep. If he's asleep while he commits the act, then there's no
actus reus; it isn't voluntary. It would be the same as if he tripped and fell on her or something (while they were both naked for whatever reason).
I don't know about "giving rapists ideas," because this has been part of the common law for centuries. And judges usually don't buy it.

The judgment has outraged women's groups.

He only suspected he had had sex after using the bathroom and discovering he was still wearing a condom, court heard. He confessed to police. Ah yes. Waking up with an unexplained condom is a common and embarrassing problem for men.
If the guy "didn't know what he was doing," I really doubt that he'd have wrapped his winky beforehand.
The judge needs to be punished. Perhaps by a fellow who later wakes up wearing an unexplained condom.
