LANCASTER, Pa. - A 14-year-old girl whose 18-year-old boyfriend allegedly fatally shot her parents left willingly with him after the slayings and was not kidnapped, prosecutors said in court papers filed Monday.
Kara Borden told detectives she left of her own free will, according to the filing. David Ludwig told detectives the two planned to get married and start a new life together.
Ludwig confessed to the slayings after his arrest and told police where to find the murder weapon in his car, according to court documents released Monday in Indiana.
In court documents filed in Pennsylvania, prosecutors said Kara Borden ran from her home to get into Ludwig's car after the Nov. 13 shootings.
"(Kara) told the defendant that she wanted to stay with him, and they drove west with the intent to 'get as far away as possible, get married, and start a new life,'" Ludwig told detectives, according to the court papers.
District Attorney Donald Totaro said Monday the kidnapping charge against Ludwig, of Lititz, will be dropped at his preliminary hearing next month.
Earlier Monday, Indiana authorities released a search warrant affidavit for the car the couple drove nearly 600 miles from the murder scene in central Pennsylvania to Indiana.
Ludwig told Indiana State Police that a Glock semiautomatic pistol he used to kill Michael and Cathryn Borden was under the driver's front seat of his parents' car, according to the affidavit.
Police seized a .40-caliber Glock pistol, a .223-caliber rifle and several articles of black clothing under a search warrant executed Wednesday. Under a separate search warrant executed Friday, police said they found a .45-caliber Colt pistol, a screwdriver, several maps and two Indiana license plates.
Ludwig told police that there were several guns in the car.
"He certainly did make a statement and cooperated with police," said Hendricks County (Ind.) prosecutor Patricia A. Baldwin. "They basically let him talk is what they did."
Police have said the murder weapon was a .40-caliber handgun.
Ludwig is being held without bail, awaiting a Dec. 16 preliminary hearing on charges that he shot the Bordens in their home in Lititz on Nov. 13. Police allege the shootings occurred after an argument over Ludwig's relationship with Kara Borden.
Police caught up to Ludwig and Borden Nov. 14 after a chase that ended with him crashing the car into a tree in Belleville, Ind.
James Gratton, a public defender representing Ludwig, said he was aware that his client had given a statement to Indiana authorities, but did not know specifically what he told them.
Neither Ludwig nor the girl, who has not been charged, was injured in the crash.
Investigators said previously they were treating Kara Borden as a crime victim but that the investigation was continuing.
In a court filing Friday, Ludwig's attorneys said they wanted investigators to preserve evidence in Ludwig's wallet, such as receipts from their journey, so that surveillance video could be obtained. The video would show that he didn't kidnap the girl, the attorneys said.
Sheesh - stupid at 14 for me was smoking a cigarette (which I hated). At 16, it was sneaking a drink (which I didn't like much better).
This was to be expected. There's been too much chatter around here that she went willingly. Their "secret" wasn't all that secret.
Thank you ..... I thought I wasn't on FR for a moment. People should read her blog comments before they decide she is an innocent.
I don't know about you, but I never had the nerve to stay out all night with a boy when I was growing up; much less when I was 14.
Is this the same police department that covered over his escapade kidnapping (???) another girl last year and taking to his parent't hunting cabin?
Did it go to the police? I thought the families "handled" it.
My husband mentioned that with all the violent video games he's not at all shocked that kids so young could blow the parents heads off and not feel any emotion over it, they are desensitized.
Running after him isn't exactly the same as being drug.
The impression I was left with was the police got involved but since the families settled between them no charges were brought against Ludwig.
Exactly. I can't understand why the family and the community are sticking by her. They ought to be calling for justice.
She even had the nerve to attend the funeral.
Nope, my dad would have killed ME if I even thought about spending the night out at 14. Couldn't even go on a date till 16, and even then my little sister had to go along. I doubt these parents encouraged her to spend the night out either, hence the fight and subsequent murders.
~LOL~ my dad, too..... my first date he stood up (he was quite tall) and asked the boy if he knew how to behave on a date with his daughter. I wanted to fall through the floor I was so embarassed.
You are probably right. The "bad seed" will always be a mystery to those with a conscience. If your theory is correct, she will never feel much remorse, but she will ask for pitty for being an orphan.
I think so, if that story is true. I can't recall where I read that the police didn't do anything at the request of the involved families, probably in someone's blog.
Of course, other things I've read about this case in blogs and commentary have ended up in the mainstream news, purported to be true.
I missed that.....did the article state that she AGREED her parents must die?
that's the problem....they don't think....they react...
its 2005 and our young people live in their own world...
a world made up of rap crap, rock and roll crap, violent video games and movies.....a world where a boy is a man if he can act violent and girl is a woman if she can act like a slut.....
I want to hear again that our present death culture isn't prodding our young people into self destruction......
so two more adults dead....kids without parents now....and two young people who have completely ruined their entire lives....for what?....a moment of chaos
Yeah, I can't count the number of times I conspired to murderl my parents so I could do what I wanted.
Apparently these super-cops did. It must have been one big car! Check this out from CNN:
"Indiana police found two other guns along with the Glock that investigators said was used to kill the Bordens -- a Ruger .45-caliber semiautomatic pistol and a Ruger .223-caliber mini-rifle -- and ammunition inside the car. A second search two days later also turned up a Colt .45-caliber pistol, 45 bullets and a holster, the documents state."
Took a second search to find that tiny Colt .45 and 2 boxes o' ammo. So small and such a big car... I can see how they'd miss 'em in the first search.
This girl was disturbed just as much as the perp, in my opinion.
The parents were apparently on to the situation prior. The girl would make other forays to sneak out out of the house.
