Monica Bolling Williamson filed a wrongful death lawsuit against Fisher-Price, K-Mart, Lifestar Ambulance Services and Danny Williamson, Jr. alleging the defendants were responsible for the death of her son.
Williamson claims that on Nov. 11, 2003, her son, Khalil Williamson, was sleeping in a bassinet of the Fisher-Price Nursery Center when it collapsed causing him to slide out and into the bottom of the play yard. The child's death was attributed to injuries sustained in the accident.
Represented by Roy Dripps and Rodney Caffey of the Lakin Law Firm, Williamson is seeking damages in excess of $750,000 plus all costs of the suit, which was filed Nov. 9 in Madison County Circuit Court.
According to Williamson, the nursery center was unreasonably dangerous and defective because Fisher-Price failed to:
# Design the nursery center with safe securement to the play yard;
# Warn consumers concerning asphyxiation hazard associated with the bassinet not being securely attached to the play yard;
# Provide adequate instructions on design deficiencies;
# Provide adequate instructions concerning the proper positioning and securing of the bassinet to the play yard;
# Design or manufacture the nursery center with the bassinet securely fastened to the play yards top rails; and
# Design the play yard in a manner not requiring the use of bassinet support clips.
Williamson also claims that Lifestar Ambulance failed to initiate an intravenous line and failed to administer advanced cardiac life support medication to her son.
According to the complaint, K-Mart was negligent because it recommended people buy the Fisher-Price Nursery Center.
Danny Williamson, Jr. was named in the suit because he did not follow instructions while assembling the nursery center. The complaint does not indicate his relationship to the plaintiff.
Williamson claims that Khalil suffered pain and suffering prior to his death.
While I feel her grief, did she leave anyone out of the lawsuits other than you and I? Yes, the infant, God love him, did suffer pain and suffering - but where was she at? It surely made a noise when it collapsed.
They forgot to sue the planet Earth for amassing a gravitational field and how could they miss blaming Bush???

I raised 3 kids with few Fisher-Price goodies. They fell off the bed, out of highchairs on their heads, they fell out the front door in their hoola-coups, etc. They all survived somehow and are doing well today. Could it be there are too many things today...the whole menagerie of junk that kids have to have for self-esteem? What is this crib, anyway, and is it really so high as to cause serious injury if it fell? This seems implausable. Makes me wonder if there were not some prior injuries to this child that are being covered-up from this crib collapsing. This doesn't sound so much like a grieving parent as it does a way to get attention taken away from something else. Maybe I'm just becoming too cynical.

I have to wonder what would cause the death - even of an infant for slipping through - Even if it all collapsed in on him - it doesn't make sense.
I'm no lawyer, but it doesn't make much sense to sue the guy who didn't follow instructions correctly when he assembled it, and at the same time, sue the manufacturer.

Wow, although this is terrible, this Mom is suing everyone in sight! Did she check to make sure the thing was put together right before placing her baby in the deathtrap? Wouldn't that be sensible. Maybe she should sue herself too.

Just for a day, I'd like to be a judge so I can put on my Jack Nicholson demeanor, glare at these seedy examples of lawyers and snarl, "Get the f**k outta my courtroom. If you say one more word, I'm not gonna fine ya for contempt; I'm gonna take this gavel and BASH YOUR BRAINS IN! That's right; I'm gonna bash 'em right the f**k in! Has it ever occurred to you that I might have better things to do with my day than listen to your silly whining? Do you have the slightest idea what an ethical or moral principle is? reading this it sounds like Fisher Price runs a nursery where they keep kids in bassinets outside in a play yard. Can anybody clear up the confusion for me?

It makes sense if the guy that assembles it doesn't have any money but the manufacturer does.
Once the lawyers are trotted out, I cease to feel sorry for people. How terrible to lose a child, but to exploit the child's death for cash, what a low-life.
That does look like quite a drop for an infant. Not a great idea all around for such a contraption. The padded sides could easily suffocate an infant and since it's so padded it doesn't appear it would have made a noise if it fell in.
