Rhetorical question:
If a Democrat committed treason, really, really, really bad treason, the kind that resulted in thousands of American deaths, would the democrats be able to find a reason to investigate and prosecute?
I'm not so sure it would be ILLEGAL Jim Robinson to divulge the IP address or other information about someone who breached his User Agreement. But I'm no expert on the ECPA or similar laws.
The WashPost has sworn on a stack of Bibles, so to speak, that it got the code from MD4Bush legitimately, "through an intermediary." And, FreeRepublic is under attack on this very subject.
Under those unique circumstances, which have never applied to any other of the 200,000 or so participants on FreeRepublic, my conclusion is that JimRob may release the access information (computers used, exact times of day, etc.) on MD4Bush, as he, JimRob) chooses.
Does that make senses to you, JimRob? You have paid me a quarter in hand received, and this is legal advice from a fairly experienced First Amendment lawyer.
