Senate Democrats pushed on Tuesday for a 2006 date for hearings on Supreme Court nominee Samuel Alito, challenging President Bush's call for confirmation by year's end.

PS.. There is a way to defeat this nonsense. When the Senate goes into recess for the "Christmas break", the President should appoint Alito [recess appointment]. That would have the Commie-libs fit to be tied.
Not that they had any chance of it, their invocation of Rule 21 today eliminated what small chance they had.

If they can delay Alito's hearings, it implies Bush is weak...and they can concentrate on their pet project: driving him out of office. A speedy confirmation would emphasize Bush's strength and take headlines away from the Wilson nonsense. This is all about '06 and '08.

Whether you want to hear it or not, Bush is weak. A lame duck president with many opposed to the war, suffering from controversy about the Plame affair, the rising energy crisis, as well as other issues.
But none of the above should influence or derail the confirmation.
Not very many lame duck presidents held working majorities in both houses of Congress.
2006 will be the determinant.

Heheheh. It's not his style though. President Bush gives the Senate a chance to hanlde the nomination before he recess appoints.
But a little known fact is that ALL pending nominations are returned to the President upon a recess of more than 30 days.
RULE XXXI
EXECUTIVE SESSION - PROCEEDINGS ON NOMINATIONS... Nominations neither confirmed nor rejected during the session at which they are made shall not be acted upon at any succeeding session without being again made to the Senate by the President; and if the Senate shall adjourn or take a recess for more than thirty days, all nominations pending and not finally acted upon at the time of taking such adjournment or recess shall be returned by the Secretary to the President, and shall not again be considered unless they shall again be made to the Senate by the President.
There are a number of pending nominations for Circuir Courts of Appeal, including Myers (9th Circuit) who has been out of Committee since March 17, and Boyle who was voted out of Committee on June 16. In addition to those two, the following four have languished in Committee (date of first GWB nomination to the position): Haynes (Sept 29, 2003), Nielson (Nov 8, 2001), Saad (Nov 8, 2001) and Kavanaugh (July 25, 2003).
Saad and Myers were the subjects of cloture abuse in the 108th Congress. Here's a piece of trivia, Boyle was nominated to 4th Cir. in 1991 too, by GHWB.
