Teacher dies from beating Oct 30, 2005, 07:44 PM

WAFF 48 News has learned the teacher who was brutally beaten at Valley school has died.

The attack happened Wednesday inside the Lawrence County Family Education building in Moulton.

Doctors say Judy Jester's condition worsened and she never regained consciousness.

She died Sunday afternoon at Huntsville Hospital.

Jester was a first grade teacher at Hatton Elementary School.

She was found bleeding and unconscious inside the Lawrence County Family Education building in Moulton Wednesday night.

Investigators say the she had been beaten several times in the head and face.

Jester suffered a fractured skull and a brain stroke.

A 15-year old is accused of attacking her.

The unidentified teenager is being held at a detention center in Lauderdale County.

Police believe robbery may have been the motive behind the beating.

The teenager faces robbery, burglary and attempted murder charges, but now those charges are expected to be upgraded.

The teenager could be charged as an adult.

WAFF 48 News will continue to follow this story and will bring you new details as we get them.

Good thing Alabama has the death penalty. I hope he gets it.

That would be fitting but remember our wonderful Supreme Court said it was unconstitutional to execute the "children" who do these killings.

Hence, trying to make it appear as if the Court based its ruling on Europe or Africa or Asia is a total distortion.

Not when the judges openly admit it and call for the practice of looking at "international" law.

Actually the Founders were well versed in the study of foreign law. Blackstone, Montesque, Puffendorf, and English Common law were the backbone of their legal studies and were constantly consulted.

Thus I would say this leaves me with an understanding of their philosophies and training and you with nothing but ideological claptrap. Perhaps you should actually read the Federalist and Hamilton's writings before pretending you know something about this.

That is all very nice but there is really no such thing as "international" law merely the law codes of different nations and treaties. There is nothing wrong with studying those codes any more than there would be for an American scientist to study science in Russia or China.

Those who believe they cannot learn from others generally don't.

How does interpreting the Constitution equate to learning nothing of other legal codes? Besides the Constitution does not define "cruel and unusual punishment" that must be derived from other sources. And that was the issue in the child murderer case.

I agree that cases should not be DECIDED based upon other codes but that is not what happened.

Seriously, I have failed and failed miserably times without number. In a lot of ways I guess I am "successful" now, but I realize it is tenuous and could change on a dime. It is not failing that makes a failure. It is quitting, or giving up. It is also persistence that makes for success. That characteristic beats talent, brains, personality, good looks, and just about everything else. You win if you are just too stupid to lie down and quit. I have my parents to thank for that viewpoint on life (and athletics). I just feel sorry for the kids who have no one there to say "I believe in you." Tell a kid he is a sack of shit enough and part of him believes you, whether he is white or black. I don't feel guilty about all the wasted lives of kids (especially black kids, but plenty in every race) as much as I feel sad for all the wasted, beautiful potential.

It shouldn't be but you know damn good and well it this had been reversed, as in the teacher was black and the assailant was white, both races would have been reported in the piece.

Precisely. As it should be. The wrong is reporting the race in ANY such story. It's irrelevant.

We're going in circles. The media is wrong, I agree with you.

I'm just trying to say that I believe it is wrong to say "well, they report it if it's whites, so they should report it for blacks." I believe the correct approach is to say race is irrelevant, and unless they're trying to describe and apprehend a criminal at large, race should not be reported at all.

Of course it's wrong but that's the point. It should be left alone. Period. But it isn't unless it's a white man committing the crime. It should either be race reported in either case or no race reported at all regardless of the race of the accused. That is not the way it is in the media and you know it. But, you're right, we are going around in circles.
