PROSECUTOR PLANS ON CALLING CHENEY AS WITNESS IN OPEN COURT; EXECUTIVE PRIVILEGE FIGHT LOOMS

Special Counsel Patrick Fitzgerald is planning to call Vice President Dick Cheney as a witness in the trial of Lewis Libby, the DRUDGE REPORT has leaned.

But the high stakes move could result in an executive privilege showdown between the White House and Fitzgerald, a top government source said Sunday.

"If Mr. Fitzgerald is going to demand a public recounting of conversations between the vice president, or even the president, and his staff, on matters he, himself, has acknowledged are 'classified,' executive privilege will obviously be invoked."

Fitzgerald has made it clear to lawyers involved in the case that he prefers Cheney appear as a witness in open court.

"Mr. Fitzgerald is starting from the position that this should not be done on remote or videotape," the well-placed source said.

Fitzgerald and Libby's attorney Joseph Tate discussed possible plea options before the indictment was issued last week, TIME magazine reports in new editions. But the deal was scotched because the prosecutor insisted that Libby do some "serious" jail time.

remember less than a week ago. the abc scoop. this story must go on it gives the press and people like drudge relevancy. drudge is yesterdays news. his site is a conduit. never breaking news. the blue dress was long ago.

This is BS for SO many reasons...one of which is that Cheney's conversations ...whether classified or not...are perfectly legal to discuss with his chief of staff. Libby is NOT saying the Cheney didn't tell him. He's saying that he remembered, incorrectly, the timing of those conversations. A deposition or videotaped (like CLINTON DID) would give the prosecutor what he wants....but he doesn't want the facts.

Agreed in spades. Wilson should be indicted for espionage
for his trip to Niger and subsequent conduct,and Plame should be fired, discharged and run out of the CIA on a rail. Since when are employees of the executive arm of government allowed to traduce the policy of a sitting President of the United States? Why hasn't the AG indicted Wilson?

This is an out of control prosecutor.

Cheney has the right to tell his Chief of Staff anything he wishes, but the prosecutor is not entitled to those private communications.

I hope that Cheney claims executive privilege, something that Clinton did repeatedly for 8 years and even made new rules in order to claim the privilege.

Confirmation of an out of control prosecutor. Robert Ray knew that Hillary lied repeatedly in her testimony and did not go forward with a prosecution for the good of the country. I see that prosecutors who favor Democrats have no such worries.

Fitz is going to want to call everyone he can in the WH as a witness. We have a looooooong time before any trial begins. Not to mention the issues that are going to arise when reporters and CIA employees are called to testify.

Fitzgerald's call for Cheney's testimony is sure to drag this thing on for years.

That executive privilege claim alone will take 18 months to make it to the Supreme Court.

What was maybe a two year case just turned into a 4 year case, and if continued, will be decided long after Bush leaves the White House.

The special prosecutor has spent a lot of money and he hasnt got squat. He believes if he can put something over on Cheney the Dims wont feel so badly because he didnt find anything wrong, so he goes for this bit of drama.Cheney should tell him to GFH like he told Leahy.

He already has the notes from the meeting where Cheney briefed Libby on this. This is a pure political play. Anyone who tells me they don't think Fitzgerald is in the bag for the Dems after seeing this, is nuts.
