PROSECUTOR PLANS ON CALLING CHENEY AS WITNESS IN OPEN COURT; EXECUTIVE PRIVILEGE FIGHT LOOMS

Special Counsel Patrick Fitzgerald is planning to call Vice President Dick Cheney as a witness in the trial of Lewis Libby, the DRUDGE REPORT has leaned.

But the high stakes move could result in an executive privilege showdown between the White House and Fitzgerald, a top government source said Sunday.

"If Mr. Fitzgerald is going to demand a public recounting of conversations between the vice president, or even the president, and his staff, on matters he, himself, has acknowledged are 'classified,' executive privilege will obviously be invoked."

Fitzgerald has made it clear to lawyers involved in the case that he prefers Cheney appear as a witness in open court.

"Mr. Fitzgerald is starting from the position that this should not be done on remote or videotape," the well-placed source said.

Fitzgerald and Libby's attorney Joseph Tate discussed possible plea options before the indictment was issued last week, TIME magazine reports in new editions. But the deal was scotched because the prosecutor insisted that Libby do some "serious" jail time.

You mean like Mr. Plame lied about who sent him to "investigate"? And if there were WMDs? And if he were qualified? Plainly, Valerie and he were carelesly "outing" her for years. Did either of THESE TWO testify under oath? Don't think so, therefore their lies are still swirling around.

What the hell is wrong with the Right, always recusing themselves? The Left never does. This prosecutor has nowone noe to oversee his radical witch hunt, he is looking for fame & headlines - period. And he didn't even talk with Valerie's neighbors until LAST WEEK! After TWO YEARS of investigations! Disgustingly biased. Why am I NOT surprised?

Agreed. He may have thought lying would save himself from embarrassment and the WH from political hot water, but if he DID perjure himself, he is the one to blame. However, I think Fitz believes that he's protecting someone higher...but I don't think so at all. Bush and company did NOT invoke executive privelege like the Clinton's did COUNTLESS times. Libby going to jail will NOT stop the Dems from keeping this going anyway! They'll keep it going as long as they can, so he might as well fight it.

Does anybody think Cheney is going to say anything that Libby is going to say is false? I suppose it is possible, but if not, can't the defense and prosecution just get together and make a stipulation as to the facts regarding what Cheney said to Libby?

And we don't expect Cheney to change his story at this point, that would certainly cause a much bigger problem...

Very little of the Times news has been true. They did just like the rest. Guessed that Libby and Rove MAY get indicted.

PROOF THAT FITZ IS PLAYING POLITICS.

He knows he is going to ask Cheney about classified info. He knows that it will have to be closed to the public.

Fitz will ask for a public questioning...knowing it can't happen...SO he can scream over up and obstruction.

The fact that he indicted Libby on hearsay that was obvious as hell hearsay....shows it all.

If true (and I wouldn't bet on it) Imthrowingafitz has now gone over the top. He will get no such thing.

As Bush's numbers go up (and tomorrow is the start of that with SCOTUS nominee) Imthrowingafitz's numbers go down. He will looooose this one. Getting too cocky.

The idiot should call the CIA to the stand. That way, he might be a wee bit closer to finding out why liberals are allowed to run covert operations against a sitting president during a time of war. This nonsense needs to end right now.

Absolutely - the CIA hides behind classified and so cannot tell anyone! It has to end, a housecleaning is in order ASAP if Bush want to stop the coup and survive through 2008.

Yep....fat Russert and egghead Cooper are not in the clear yet.

If Libby walks...then it means Cooper and Russert lied.

COUNT ON LIBBY'S ATTY CALLING RUSSERT AND COOPER TO THE STAND.

If they don't have their stories planned together like the did for Fitz....they are toast.

That's all the indictment of Libby has to really go on...is their hearsay

That`s about it. Fitzgerald piled on with the indictmetns hoping to pressure Libby into rolling over on Cheney or who ever else Fitzgerald thinks is guilty of something.

Now that Fitzgerald`s failed with that old cheap trick he`s trying to stirke fear into Cheney,hoping Cheney will run to Libby and tell him to beg for a plea bargain.

Bottom line - Fitzgerald has nothing.

I have to tell you D-1 I was shocked at his press conference. We had all been told what a sharp, tough prosecutor he was, but it was embarrassing to watch.
