He did already. Miers was in a sense by consensus with the Democrats. In fact, her name was suggested by Democratic Minority Leader, Harry Reid. Yet, it didn't turn out well. So, let's try a different way, shall we?

"I urge the president to take seriously the Constitution's charge and to engage the U.S. Senate both Republicans and Democrats in a process of genuine consultation in order to identify and ultimately confirm a consensus nominee," the New York senator said in a statement Thursday. First: The Constitution doesn't say ANYTHING about genuine consultation nor about getting a consensus nominee.
Second: The Senator's HINO (Husband in name only) did not engage the republicans in the senate (even though they were the majority party) to come up with "consensus" nominees when he was president.
