Democrats on the House Judiciary Committee are so pleased with reports that Leakgate prosecutor Patrick Fitzgerald is about to indict senior White House officials that they want him to lead an impeachment investigation into whether President Bush lied to Congress about Iraq's weapons of mass destruction.
"The CIA leak issue is only the tip of the iceberg, House Judiciary Democrat Jerrold Nadler complains in a message posted to his web site.
In a letter asking the Justice Department to expand the scope of Fitzgerald's investigation, Nadler says: "We now have reason to believe that high crimes may have been committed at the highest level [and] wrongdoing that may have led us to war and imperiled our national security.
If there is evidence that Bush or Cheney authorized aides to deliberately mislead lawmakers, Nadler told Congressional Quarterly: "That would be an impeachable offense.'"
The Manhattan Democrat is asking Acting Deputy Attorney General Robert McCallum to direct Fitzgerald to probe efforts by the White House to discredit critics of the Iraq war like former Ambassador Joe Wilson. Nadler wants Fitzgerald to determine whether attacks on Wilson were part of a "broader conspiracy knowingly to mislead Congress into authorizing a war."
Even before leaks from Fitzgerald's investigation indicated he planned indictments, Rep. Maurice Hinchey let slip the Democrats' plan to impeach Bush for alleged Iraq war lies.
In quotes picked up by the Ithaca Journal, Hinchey said in August: "My greatest hope is that all of these things will be revealed, they will be revealed in a very direct and legal context, and that in 2006 a Democratic majority will be elected to the House of Representatives, and in February of [2007] impeachment proceedings will begin."
They couldn't even schedule an impeachment vote.

I don't think the dims control either body of Congress, last time I looked. They certainly can't direct or order any person or group to do anything...they are not the party in power. Doughboy Nadler can rant all he wants but the lowly dims are not in power, no matter what they think.

Nadler is one of the guys the Democrats trot out whenever they feel the need to convince the true-believers, Kool-Aid drinkers on DU and the MoveOn.org mailing list that they really are "acting" on what the nutcase, moonbat base really wants. He's just "important" (mostly just name-id amongst the Left) enough for them to thing that their leadership is taking them seriously, but not enough to show up on the radarscreens of mainstream and swing voters.
IOW, these comments are just pandering by one of the Dem's designated panderers.
One thing to consider is that there has been a good deal of analysis (I think Charlie Cook produced one of them) showing that the chances of the Republicans losing the House are slight. Blue districts are becoming blue-er, Red districts are becoming Redder and thanks to the Democrats "shoot your own foot" decision to segregate something like 25% of their base in majority-minority districts (rather than spreading the overwhelmingly Democratic precincts out to create swing districts) the House looks to be fairly stable in seat apportionment until after the next census.
Doesn't mean that Republicans and Conservatives should take things for granted (promoting the idea that the Democrats will launch impeachment hearings if they retake the House works as well at mobilizing our base as theirs) and we really need to work hard to ensure that the current majority exists after 2006 ... but it does seem to indicate that at this point the Dems feel they need to pander to their base.

Unfortunately, because of the nature of Grand Jury proceedings and legal matters in general, the Bush Administration has not been able to frame the debate on this.
I listened to a Democratic strategist yesterday on Fox and she is saying that if there are indictments all Americans will be disgusted. The implication is that Bush people tried to smear a critic.
The Republicans have to quickly get an alternate narrative out. The CIA and MSM tried to discredit a President during a time of war.
Given the legal weakness of the underlying case against Rove, et al, I suspect Fitzgerald has been getting people to testify again and again on essentially the same issues to develop conflicts of testimony where there weren't any in the first place and then use those conflicts to generate perjury and obstruction of justice charges. It isn't that hard a thing to do when a prosecutor has two years and unlimited funds to pursue this kind of activity. Indeed, given how hard it is to remember events over such a long period of time, it's very likely that good faith discrepancies between witnesses and within individual witnesses' testimony will develop, discepancies an unscrupulous prosecutor can exploit to manufacture perjury and obstruction of justice charges.
Worst of all, convictions aren't even needed in a situation like this. Being indicted is a horrific experience, one that's likely to cost Rove, Libby, or anybody else who is targeted well over a million dollars to defend against. Naturally, while the case is going on the man is incapacitated from doing his job. That incapacitation is just what the DemonRats want, even if there's no conviction. The present WH disorganization shows how destructive that incapacitation can be.
As a partial aside I can say that, although I oppose the Miers nomination and believe it's dead wrong, I continue wholeheartedly to support President Bush because we've got to win the WOT and defeat the DemonRats. The Miers thing is a family fight, and we must not let it destroy the family.
