MIERS & LAST-MINUTE DROP-OUTS [Kathryn Jean Lopez] A journalist friend just spoke with a top Texas lawyer who spoke with Priscilla Owen last week. He says that she "most emphatically" did not withdraw her name from consideration to the Court. If the White House spin is that Harriet Miers got the job because nobody else wanted it, it would seem that the White House is at a desperation point. Posted at 12:07 PM

Even if they would have filibustered, so what? He got a fight he didn't want by picking Miers. Wrong war, wrong time, as JF'in K used to say. Would have been better off fighting the bad guys instead of us.

I think K-Lo is referring to statements by Dr. Dobson, who said Rove told him 80% of the women who were on the short list dropped themselves out.

Apparently, one of the qualifiers Bush had was that the nominee had to be a woman.

And it's going to get worse if Miers does withdraw and the president ... and I'd be willing to bet the head of my firstborn that this will be the case ... again fails to nominate somebody on the order of Brown, Owen or Luttig.

Don't be surprised if he nominates Edith Clement or Consuela Callahan.

Clement was supposedly the second choice after John Roberts.

You're on the right track here. I've said this until I'm blue in the face, but once more, we are reaping the fallout from not doing the constitutional option when we had a chance. THEN and THERE is where the fight should've been waged to settle this once and for all and codify a simple majority as the threshold to be met for approval of judicial nominations, because of the SCOTUS implications. And I fear that chance is now gone with the wind.

I'd look for a graceful withdrawl, from the nominee, of course, maybe early next week.

Only if Harriet decides to. Bush will not force the issue.

There are going to be a lot of people with egg on their faces (pundits and Freepers alike)

I think that is minor fallout in the scheme of things. I'm concerned for the advancement of judicial conservatism and preservation of a constitutional republic.

The notion that Priscilla Owen or Janice Rogers Brown withdrew themselves from consideration is totally ridiculous IMHO. They just went through vitriolic confirmation battles and their actions in the weeks preceding the Miers nomination gave every bit the appearance of those who would want to reach the Supreme Court. Moreover, this is the life dream of every lawyer, and they're gonna wait for lightning to strike twice??

Wow, seems to be on a par with the arguments to support Ms. Miers. Seems that a guy who knew this woman who used to cut her dog's hair heard her say once that she had just bought Constitutional Interpretation for Dummies and was studying up for the hearings. That was all I needed to hear to call my Senators with my enthusiastic support!!!!

Probably a good bet, but you should never bet anything you are not willing to lose. I doubt choice #2 will be an improvement.
