I have changed my mind about Harriet Miers. Last Thursday, I wrote in OpinionJournal's Political Diary that "while skepticism of Ms. Miers is justified, the time is fast approaching when such expressions should be muted until the Senate hearings begin. At that point, Ms. Miers will finally be able to speak for herself."
But that was before I interviewed more than a dozen of her friends and colleagues along with political players in Texas. I came away convinced that questions about Ms. Miers should be raised now--and loudly--because she has spent her entire life avoiding giving a clear picture of herself. "She is unrevealing to the point that it's an obsession," says one of her close colleagues at her law firm.
White House aides who have worked with her for five years report she zealously advocated the president's views, but never gave any hint of her own. Indeed, when the Dallas Morning News once asked Ms. Miers to finish the sentence, "Behind my back, people say . . .," she responded, ". . . they can't figure me out."
Conservatives shouldn't care about her personal views on issues if they can convince themselves that she agrees with Chief Justice John Roberts's view of a judge's role: that cases should be decided the way an umpire calls balls and strikes, without rooting for either team. But the evidence of Ms. Miers's views on jurisprudence resemble a beach on which someone has walked without leaving any footprints: no court opinions, no law review articles, and no internal memos that President Bush is going to share with the Senate.

Wasn't this the same concern that was voiced about Roberts before the hearings?
I remember one commentator saying Roberts had lived his life as if he knew that someday he'd be sitting before a Senate panel with a nomination for the Supreme Court.
It's been posted already, but another nail in the coffin of this nomination.
OK, I bet that in the next 10 minutes, someone will say either
1) I trust the President, he knows her.
2) I trust her, she is an Evangelical Christian.
3) Rehnquist wasn't a judge, either.
4) Stop bashing, go back to DU.

To a much lesser extent. Roberts background was solidly conservative fighting for conservative principles and a couple years on the bench with conservative rulings. Miers has a mixed background and no time on the bench.
Yes that is the recipe for the kool aid, alright.

I don't think any of this would have happened if Rush hadn't made a big deal about a "showdown" with the left. He has the luxury of being insulated from the WH and its goings-on while W and Rove have to deal with immoderate Republicans, a slanted press and insane liberals. W is in a no-win situation no matter what he does. Sometimes Rush needs to hold his tongue.

Which is why we should quit the name calling here at FR, and ALL of us try and figure out as clear a picture as possible of this possible SCOTUS Justice. This is too important for name calling on one another. Just one FREEPERS opinion.

Rush speaks for a huge segment of the Conservative Base. If he held his tongue we might either be in the second Gore term or the first Kerry term. The President and Rove should tune in and listen now and then.
