1) Estrada WAS considered initially, and 2) the President knew WELL before the public that Owens wasn't interesting in the USSC nomination. [BTW: It seems as thought most of the 'public' here at FR still doesn't know that Owens withdrew her name from the nomination list!]

This line of thought only encourages me to two thoughts.
A) Expose the scum. Do not appease. It'll be bloody but the clean up would be good.
B) Do not vote for them.
I do not bow to blackmail. I like my House Rep. That may be all I vote for next year, persuent to this line of thought being true, given my state is WA and I see no reason I should support anyone that will morph into someone else that would blackmail the president.

What I am telling you is that Miers is indeed all you can get. And if there is another opening, you are going to get another Miers, and another one after that, because you will probably have the very same Senate or worse. Will the GOP complain about this abomination? You are asserting that the President is compromising on nominations, because he has to get a 60 vote supermajority.
Miers migh be great - this isn't about her. This is about whether or not the GOP will fight for principle. Your screed aims to justify not fighting for principle.

Wouldn't the best strategy be to leave the RINOs were they are and try to replace the dems?
I guess my overarching view (coming from the area that kicked out Foley when everyone said it wasn't possible) is that it HAS to come from the ground up, not the other way. Which makes dumping guys like McCain and Collins/Snowe really difficult.

..He named one specifically, and said she had too much history/baggage that would have been held against her. Not exactly the same thing. He said when they were vetting Batchelder (sp?), they found a lot of judicial activism. He didn't explain more fully, but he did say they were surprised.
