WASHINGTON -- Senators beginning what ought to be a protracted and exacting scrutiny of Harriet Miers should be guided by three rules. First, it is not important that she be confirmed. Second, it might be very important that she not be. Third, the presumption -- perhaps rebuttable but certainly in need of rebutting -- should be that her nomination is not a defensible exercise of presidential discretion to which senatorial deference is due.

Not as many as you have trashing Bush.

The entire pro-Miers argument is redolent of defeatism.

The mere fact that this nomination has provoked a debate among people who should be on the same page on this issue-if nothing else-should tell you something.

The mere fact people, including yourself, are trashing the same individual who vetted such stellar candidates as Edith Jones, Janice Rogers Brown, and John Roberts should tell you something.

I've proven on a number of occasions in this thread alone that you are a fool.

The entire pro-Miers argument is redolent of defeatism.

Throwing the individual who vetted stellar candidates for judicial appointments out the window is rooted in defeatism.

I truly understand where you are coming from. I don't have a koolAid cup poised at my lips. I think there is a lot to be said for the comfort level a JRB appointment would bring.

There has got to be a reason for this strategy. If you are going to look for reasons, you must look at the requirements for confirmation.

It all comes down to politics in the Senate. My perception is that the Brains at the Whitehouse believe they can't get a known conservative through the Seven Dwarves. They could have nominated someone that was a known quantity, but wasn't as conservative as Owens or JRB. That could have happened, I'm sure that would work. None of us would be happy.

What we have is an undisclosed strategy with an unknown candidate. I'll put up a straw man, that you are free to knock down with logic, that the intent is to try to force an Idealogue on the court in this manner.

Theres no proof to substantiate this, or discount it, it's just a strong possibility. Stronger than the possibility that they are strategically planning to fail. I'm paranoid, but I don't think they are purposely planning to sneak a moderate on the bench.

I have ZERO faith in the Snow Frist and his Seven Dwarves. I don't see any proof that they can deliver what we really want. But, maybe we can get what we need. They came up tiny on the nuclear option. If you can you honestly guaruntee me that the senate will deliver a JRB then I am there. But, I'm not at all confident when it comes to these guys. They are WORTHLESS.

I know that is not satisfying. I also have a problem with it. Read my posts. But, that is the stomach churning probable truth of the matter. You have seven RINO Senators to thank for that the way I make sense of the situation.

No Conservative should entrust Snowe, Collins, Chaffee, McCain, et. al., to carry the waters of Conservatism. It's wildly insane to give them such a responsibility.

You're right, the damage has already been done. Apologies if I missed your comments earlier about this (long, painful thread), but are you suggesting that since there's nothing those of us who oppose it can do to realistically defeat the confirmation, we might as well support it to salvage the political damage? If so, I agree that's the wise political calculation. I can't do something like that however. Naturally I'm speaking personally. It could be that others in our party can. That's probably a good thing if so.

You know for sure they would show up with a vegetable strainer if tasked with this responsibility. They are no more than attention whores. They lack any core beliefs. They have proven their lack of worth repeatedly.

If W can sneak an idealogue on the bench in this matter I think we must consider this the best move.

This situation angers me to no limit, but, I don't see the outright confrontation method working. Schumer is not the problem. McClown, DemWine, Snow White....therein lies the conundrum.

I'm open to the brilliant tactical method that overrides this though...... anyone?

Right. I often refer to them as wildcards, because you don't know what they'll do next. If there's one thing for sure, they're looking for a spotlight, a camera, and a hot microphone in which to speak into.

While I disagree with much of the reactive hysteria I've seen around here against this nominee without further, clarifying, facts, I sympathize with the unease many FReepers are having at this juncture. I share that unease to a degree, and believe that FR is the perfect place to discuss, analyze, and dissect that unease--or lack of--in depth. Such discussion is part and parcel of what this forum is all about.

Alas, that tiny, self-important band of wannabe super-freeper-poseurs--whom fancy themselves as the last word on any given subject--have decided to flood these threads with the online equivalent of the vapors--a feigned pose they consistently carry off very well, having had years of practice at it.

Your posts have angered them, and caused the current caustic "swarm" of smarmy rage from some of their most vitriolic screecher's in reaction.

No matter the issue at hand, I say: keep up the good work in that regard.

If your control of the Senate is as tentative and unstable as you say, then why don't you and your ilk tone down your attacks on purist conservatives who dare to question this nominee?

The short answer is "because it's a chat room." But I've had similar questions in my mind, when a poster labels Christian conservatives, for example, "insignificant influence" on the political scene; and at the same time bemoans the criticism that comes from this "insignificant influence." If "whatever faction" is insignificant, then the opinion of that faction is also insignificant, ergo, nothing to bemoan.

In general, one-note cheerleaders (clique-leaders) are not good at reaching out or coalition building. But at the same time, that doesn't mean their votes and energy aren't valuable, because they are.
