Judge: Mich. Law Against Type of Abortion Unconstitutional

LANSING, Mich. — A federal judge has declared unconstitutional Michigan's law aimed at banning a procedure that opponents call partial-birth abortion.

In a ruling dated Monday, U.S. District Court Judge Denise Page Hood (search) in Detroit ruled the law places an "undue burden" on women's right to choose an abortion. The parties in the lawsuit learned of the ruling Wednesday.

Thanx for the comnpliment, but it was svxdave that brought it up! Its not a matter of candidate being smart enough. Its a matter of a candidate having the guts to go against the abortion lobby.

IIRC - most of Europe "allows" abortions, but only during the first trimester!

I'm pinging Michael to this (german conservative) - he will at least know the laws in Germany!!

We have to start speaking of this "right" of women, as similar to the "right" to own slaves. It took a more than half a century to end slavery in the US. The idea that a woman "owns" the person in her womb, and can decide to end its life whenever she wishes it, is an idea that will not win in the long run.

We must stress "human rights" over "women's rights."

I don´t know for the other European countries, but in Germany, abortion is generally illegal and a crime. However, the crime is not punishable if the child is aborted within the first three months by a doctor and if the woman has gotten an advice in a (state or church) counseling centre. The counseling takes a few hours, and between advice and abortion shall be a few days at least.

Eventually, abortion is legal until birth if there´s a realistic possibility that the mother may die because of the birth (this exception doesn´t lead to abuse).

Actually, although 90%+ of the US population are against PBA and for the Pledge, that has little to NOTHING to do with things. The idiots on the Judiciary Committee and those beholden to the Special Interest Groups will decide who to let sit on SCOTUS based not on what the people want (heaven forbid!), but what their own idiology and politics push them to do. (So, actually, saying that Dubya could place "anyone" on SCOTUS now because we have enough tweaked off Americans really isn't reality).

And, we know where the Demorats stand on killing "partially born" babies, tearing down the culture, overriding the will of the people on defining marriage as between a man and a woman, etc.

It's almost like they can't help themselves. They are SO in bed with these ultra-left splinter groups that they've lost touch with what they were sent there to do in the first place, and that's to represent the Will of the People. IF that were still the case, we'd have a lot more lattitude on who gets on the Court and what their political opinions on these things would be, because there'd be hell to pay for the kinds of stunts that the Dems have pulled with the process. Unfortunately, most Americas - despite being generally tweaked off about how far out of sanity we've slipped on PBA, the Pledge, "Gay Marriage" (an oxymoron), etc do NOTHING when it comes time to vote. And that's why the lunacy continues.

In Canada the courts enshrined the absolute right of abortion for all women, without even the few restrictions we are allowed to have here.

The hate crime bill doesn't bother me quite so much. After all, while I think it is stupid to take intent into account when determining how bad a crime is, at least it still only applies to people who deserve to be punished -- and if you beat up someone I'm not going to feel too bad if you get MORE time because you beat up a homosexual.

Its the laws that require people who believe homosexuality is evil to accept it that gall me.

Just about every partial-birth abortion bill has been struck down, because most don't include an exception for the health of the mother (the argument being that there is no medical problem a mother could have which would make a partial-birth abortion better for her than other options).

Virginia had it's PBA bill struck down earlier. We have known that all the PBA bills were awaiting Supreme Court review.

The democrats hope to keep O'Conner on the court long enough to hear this case and rule on it. Even if she was gone, because of the previous Supreme Court case, all the underlying courts have ruled against the bills, so a 4-4 tie won't help. We need to get a replacement for O'Conner on the bench before the case.

The Dems are also trying to get nominees to say what they would do about abortion, so that later they can force the pro-life justices to recuse themselves from cases involving abortion.
