She may very well. I was surprised to hear it yesterday too. We know that Scalia likes a good debate! I can just see his wife and Ginsberg's husband rolling their eyes at each other while the other two start in on yet another interminable discussion peppered with quotes from John Jay and various Latin phrases.

Maybe Rehnquist quietly chided him about it the time he got mugged in the park.

Might be it.

I'm with you. I have no particular personal interest in Souter's private lifestyle except as it relates to or influences Supreme Court Decisions that affect the nation as a whole.

I admit to being a little upset with the part Souter played in the SCOTUS decision making it easier for privateers to wrest prime properties from homeowners using the excuse that it will benefit the public.

Should Logan Darrow Clements succeed in taking Souter's property to build the Lost Liberty Hotel, the turnabout would teach the Court a lesson. Imagine a SC justice losing his property by his own ruling. Fat chance, though, the Weare, NH licensing board is protecting Souter and will never issue the necessary permits - but the idea is certainly interesting.

When Souter was appointed, it would have been nice to have known what his views were on holding private property. I doubt he would have been confirmed.

If memory serves correctly there were many unanswered questions about Souter's views before he was confirmed. I recall having misgivings myself, at the time.

Re: "I wonder what the story is with Souter."

At the risk of being un-PC... Souter is a 'tard.

On a collegial court, Souter's failure to issue any sort of statement is an expression of bitterness at Rehnquist. The causes are no doubt many and deeply felt. Souter has injured his standing with his colleagues and marked himself as a surly outsider.
