U.S. Chief Justice Rehnquist dead at 80 (Kennedy demands that Roberts hearing being postponed)

HIGH COURT SUCCESSOR

Rehnquist's death raised the possibility the hearings on Roberts' nomination could be postponed and gave Bush the opportunity of nominating Roberts as chief justice, a possibility administration officials have talked about in the event Rehnquist died.

Sen. Edward Kennedy (news, bio, voting record), a Massachusetts Democrat, said the consideration of successors to Rehnquist and O'Connor should be held off to allow the Bush administration and Congress to focus on the Katrina disaster.

"We should proceed carefully and appropriately in filling these important vacancies. With Justice O'Connor committing to stay until her replacement is named, we can and should remain focused first on protecting our citizens who need help the most," Kennedy said.

Frist said he would discuss with Senate Judiciary Committee leaders whether the Roberts' hearings should be postponed due to the death of Rehnquist.

To fill a second opening on the court, Bush could return to the list of candidates he considered before nominating Roberts to replace O'Connor.

Among the possible candidates are U.S. Attorney General Alberto Gonzales and appeals court Judge J. Michael Luttig. Bush could also elevate a current member of the court such as Justice Antonin Scalia or Justice Clarence Thomas.

"I cannot see any scenario that doesn't end with Scalia as Chief Justice."

I can, not the least of which is that two confirmation hearings will be bad enough. Why go through three?"

1) To bring the fight to the "enemy".

2) To make our own "forces" buck up and do that which they were hired to do.

3) To find out if our "forces" have what it takes, and if not, replace those we can in 2006.

It's first and goal on the nine yard line. We need to score!

Yeah, and if Rehnquist can pass on quietly with all the problems that poor man had, what's keeping Teddy going?

Pres. Bush needs to show his respect for blacks everywhere by appointing Justice Clarence Thomas as the first black Chief Justice of the Supreme Court. He's young enough to hold the post for decades. I'm sure that choice would be lauded by the Leftist press and race pimps and the ACLU.

But, we don't have a minute. Worse even, we don't have a Joe Montana, or (enter quarterback of choice here)

Frist is an opportunist a-wipe. That he thinks any Senator, much less one who has traded in his principles (did he ever have any?) for his "precious", the chance to be Prez is infuriating. Crossed over to the dark side, like Smeagle (LOTR)

Teddy is just looking for a delay - he figures that if he can put it on hold for a few months or a year, then the Dems can put off the nomination until after Bush is gone. Alcohol has truly pickled his brain if he thinks that the rest of us can't see through this ploy.

re: It'll be fourth and goal on the 45 yard line in a minute.

That would be a real knee-slapper if it weren't so true. This administration seems to have a knack for snatching defeat from the jaws of victory. I would love to them, all of them, act like winners and the majority instead of whipped puppies desperate for the approval of their enemies.

I cannot see any scenario that doesn't end with Scalia as Chief Justice.

I'm with you. Why would GW appoint a CJ without an established track record? Can you imagine the shape we would be in if one of the "pseudo-conservatives" appointed by Republican Presidents in the past had been named CJ before they even took the bench? Rehnquist because a Justice in 1972 and didn't become the CJ until 1986 . . . when our Beloved President Reagan had 14 years of history to use as his guide.

Besides . . . NOW is our opportunity to end all this Judicial Activism BS!! NOW!!!!!

We've got the liberals on the run in Congress, in the Senate, and in state and local politics . . . they've been using the courts to cram their agendas down our throats. Now . . . right now . . . is our best chance to end this nonsense.

I urge every FReeper to bounce out their politicians. DEMAND THAT THEY DO THE RIGHT THING -- NOMINATE TWO STAUNCH CONSERVATIVES AND BE WILLING AND PREPARED TO TAKE ON THE KENNEDYS AND SCHUMERS OF THE WORLD REGARDLESS OF HOW LONG IT TAKES!

Who cares if it takes YEARS to confirm these two Justices? Our children's future and the future of our country is at stake.

A bit melodramatic, you say?

Not one bit. Say what you will but the Buck stops at the Supreme Court because our law-makers don't have the guts to take the Supreme Court on as an institution. Nowhere in our Constitution does the Judiciary have the power to "MAKE" laws . . . but that's exactly what they've been doing. When Justices refer to European Law or European Decisions or any-damn-thing else EXCEPT OUR LAWS to justify their interpretations of OUR CONSTITUTION, I say it's time we reel them back in and demand that they only do the jobs our Founding Fathers assigned to them. They've seized legislating powers with impunity.

I say . . . ENOUGH ALREADY!!

Uh, Teddy? Maybe you didn't get the memo. Your party doesn't get to decide the timing of this. Your party lost the election. You are not the President. You are just a drunken, fat slob who will never be President because you lied about allowing Mary Jo to drown.

We'll wait for the man who is actually President to decide what to do. In the interim, if you can't personally contribute to the solutions required for Katrina beyond dragging your lard infested carcass back to the chamber early to vote on emergency relief, just pour yourself another 4 fingers of Ketel and shut your big fat yapper.

Is this Satire??? If not, it didn't take that pompous windbag long to beat the Democrat political drums. Of *course* he wants a delay because there would only be seven justices with a good chance of five being on the moonbat left in decisions. Such behavior from the Senate, that would deprive us of a fully staffed SCOTUS for its next session is *not* tolerable.

To borrow a phrase from a mayor of New Orleans, "Get off your asses."

"Is Garza a *TRUE* conservative? "

No. He could do the same with Miquel Estrada. He can also appoint Scalia as CJ and when the rats go apoplectic and start race baiting, Bush nominates Brown as AJ.

" Most Chief Justices were brought on as such, as was Rehnquist."

Actually, he was already a justice and elevated to replace Warren Burger.
